Ordinance No. 12,859ORDINANCE NO. 12,859 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING CERTAIN STREETS, ALLEYS AND EASEMENTS WITHIN THE BAY OAKS HARBOR SUBDIVISION; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. *********************************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** WHEREAS, pursuant to the Service and Assessment Plan for Baytown Public Improvement District Number One (the "PID"), the City was required to reconstruct and make certain improvements to Bay Oaks Harbor Drive and Bay Island Boulevard, which confer a special benefit to properties within the PID; and WHEREAS, once those improvements were completed and the project accepted by the City, the public improvements were required to be conveyed to the City for ownership and maintenance purposes; and WHEREAS, the City of Baytown completed approximately 4,400 linear feet of street work as part of its Bay Oaks Harbor Road Improvement Project and accepted the same on November 17, 2014; and WHEREAS. the Bay Oaks Harbor Property Association, Inc., has provided the City with a warranty deed granting all of the streets, alleys and easements shown on the amended Plat of Bay Oaks Harbor, except for those pertaining to Mallard Bayou Drive and Pelican Drive; and WHEREAS, in accordance with the Service and Assessment Plan for the PID, the City desires to accept such conveyance; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council hereby accepts the streets, alleys and easements conveyed pursuant to the warranty deed from the Bay Oaks Harbor Property Association, Inc., which is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes. .- Section 2: This ordinance shall take effect immediately from and Council of the City of Baytown.
