2010 09 09 WS MinutesMINUTES OF THE REGULAR WORK SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN September 09,2010 The City Council of the City of Baytown,Texas,met in a Regular Work Session on Thursday,September 09,2010 at 4:37 P.M.in the Council Chamber of the Baytown City Hall,2401 Market Street,Baytown,Texas with the following in attendance: Brandon Capetillo Council Member Lynn Caskey Council Member David McCartney Council Member Mercedes Renteria Council Member Scott Sheley Council Member Garrison C.Brumback City Manager Bob Leiper Deputy City Manager Kevin Trailer Assistant City Manager Ignacio Ramirez City Attorney Leticia Garza City Clerk Keith Dougherty Sergeant at Arms Mayor DonCarlos and Council Member Sain were absent from the September 09,2010 City Council Regular Work Session. Mayor Pro Tern McCartney convened the September 09,2010 City Council Regular Work Session with a quorum present at 4:37 P.M. 1.DISCUSSION a.Storm Water Management Ordinance -Health and EMS. City Manager,Garry Brumback presented the agenda item to discuss a proposed ordinance amending Chapter 98 "Utilities",Article VI."Stormwater"of the Code of Ordinances,Baytown,Texas,to provide additional definitions within Division 1 "Generally"and to include regulations for Division 2 "Stormwater Management", Subdivision 2 "Illicit Discharge Detection and Control"and Subdivision 4 "Post Construction Stormwater Runoff." Health Director,Mike Lester stated that there were a minimum of six controls required to be met to receivethe Texas Commission on Environmental Quality (TCEQ)Phase II Stormwater Management Permit and of the six controls four are ongoing and two are pending.The following controls are: Public education and outreach-ongoing; Page 2 of 4 Minutes of the September 09,2010 City Council Work Session Public involvement/participation-ongoing; Construction site runoff control-ongoing; Pollution prevention/good housekeeping for municipal operations-ongoing; Illicit discharge,detection and elimination-pending;and Post-construction storm water management in new and redevelopment-pending Mr.Lester indicated that the illicit discharge,detection and elimination will allow the City to regulate illicit discharges into our storm water system,discharges from commercial operations,regulate residential discharge of prohibited materials,and address unauthorized connections and discharges.Mr.Lester stated that currently the health department doesn't have the authority to do quality testing but this ordinance would allow them to have it.Mr.Brumback suggested adding capability to the ordinance and stated that a need for testing equipment to include the expertise to run the testing equipment will be necessary.Council Member Caskey inquired if information regarding stagnant water in retention/detention ponds and the inclusion of inserting requirements of water fountains on frontage roads should be discussed.Mr.Lester stated that information regarding stagnant water in retention/detention ponds is discussed in the post- construction storm water management.In regards to the water fountains on frontage roads,Mr.Lester indicated that clarification of a retention or detention pond is to be determined but is also in the post-construction section. Mr.Lester indicated that the post-construction in stormwater management to a new or redevelopment will require a registration/permit (at no cost)to all detention facilities within the City and a storm water management plans for development activities.Mr. Lester stated the requirements for the permit will be to have an annual inspection by a professional engineer and to properly maintain the detention pond to ensure proper functioning.Mr.Lester stated that after the public meeting and modifications,the proposed ordinance will be brought before council for discussion and approval in October.Mayor Pro Tern McCartney inquired about thefee schedule.Mr.Brumback stated that thefee schedule will be brought before council in the spring. b.Animal Services Ordinance Revisions -Health and EMS. City Manager,Garry Brumback presented the agenda item to discuss a proposed ordinance amending Chapter 14 "Animals"of the Code of Ordinances, Baytown,Texas as it reflects a full review and revision of the current Animal Services Ordinance to include: •improved definitions; •increased protections against cruelty to animals; •improved protections from nuisance animals; •compliance with State regulations concerning proper restraint of animals; •improved protection from potentially dangerous animals,and •implementation of a pet registration program. Page 3 of 4 Minutes of the September 09,2010 City Council Work Session Health Director,Mike Lester stated that on September 16,2010 a public meeting will be held at the Community Center regarding the Code of Ordinances Chapter 14 "Animals". Mr.Lester indicated that the revisions to the ordinance that have a significant impact are: Enhanced cruelty/protection of animals; Enhanced public nuisance enforcement/abatement; Enhanced restraint of animals and exceptions; Dog and cat registration/permitting; Enhanced dangerous animal enforcement abatement; Separate fee section Mr.Lester stated that according to the stats,there were 918 cats and 831 dogs impounded with owners reclaiming only 9 cats and 132 dogs.Mr.Lester indicated that the hope of the registration program is to improve on the number of pets being reclaimed to its owner instead of being euthanized.Mr.Lester stated that within the last (5)months,1,000 out of 1,291 cats and 55%of the total number of dogs were euthanized. Council Member Caskey inquired if the health department has volunteers.Mr.Lester stated that they have some volunteers,but not a Volunteer Program.Mr.Lester stated that he hopes to initiate a volunteer program after January.Council Member Caskey requested to see more information from other cities regarding the pet registration and permit. 2.APPOINTMENTS a.Baytown Beautification Advisory Commission -City Clerk. City Manager,Garry Brumback presented the agenda item to discuss three (3)reappointments and two (2)vacancies to the Baytown Beautification Advisory Commission.Cindy Coker,Richard Tunstall and Judy Wheat desire reappointment for another two (2)year term beginning on October 01,2010,and ending September 30, 2012.Jackie Harris tendered her resignation and does not desire reappointment leaving two (2)vacancies on this Commission. The City Clerk's Office is in receipt of one (1)application from Ms.Maegan Vaughan to fill one (1)vacancy. b.Baytown Industrial Development Corporation Board -City Clerk. City Manager,Garry Brumback presented the agenda item to discuss the appointment of Council Member Renteria,one (1)vacancy from Ms.Vivian Hemphill,and to confirm current members Capetillo,Caskey,McCartney,and Mayor DonCarlos to the Baytown Industrial Development Corporation Board. City Attorney,Ignacio Ramirez stated that he's doing some research on the position of a returning board member if the member is or has been out for a period of time and will inform the Council with the results. City Manager,Garry Brumback presented the agenda item to discuss the reappointments ofLory Stone and Debra Hat fie Id whose terms are set to expire on September 30,2010. Both desire reappointment and if appointed would serve another two (2)year term beginning on October 01,2010 and expiring on September 30,2012. 3.ADJOURN Mayor Pro Tem McCartney adjourned the September 09,2010,City CouncilRegular Work Session at 5:25 P.M.
