2010 05 27 WS MinutesMINUTES OF THE REGULAR WORK SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN May 27, 2010 The City Council, ULDC, and Planning and Zoning Commission of the City of Baytown, Texas, met in a Joint Work Session on Thursday, May 27, 2010 at 4:05 P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street, Baytown, Texas with the following in attendance: Brandon Capetillo Lynn Caskey David McCartney Mercedes Renteria Terry Sain Scott Sheley Stephen DonCarlos Council Member Council Member Council Member Council Member Council Member Council Member Mayor Vacancy Board Member James Haarmeyer Board Member Claire Sinclair Board Member Brenda Smith Board Member Spencer Carnes Chairman Shawn McDonald Commissioner Gilbert Chambers Commissioner Jim Hutchison Commissioner Joe Floyd Commissioner Garrison C. Brumback City Manager Bob Leiper Deputy City Manager Kevin Troller Assistant City Manager Ignacio Ramirez City Attorney Leticia Garza City Clerk Keith Dougherty Sergeant at Arms Board Members Hanson and Kelly, Commissioners Benoit, Bobbitt, Chatham, Krishner, and Valdez were absent from the May 27, 2010 Joint Work Session of the City Council, ULDC, and Planning and Zoning Commission. Mayor DonCarlos convened the May 27, 2010, Joint Work Session of the City Council, ULDC, and Planning and Zoning Commission with a quorum present at 4:05 P.M. Page 2 of 3 Minutes of the May 27, 2010 City Council Joint Work Session 1. DISCUSSION a. Joint Work Session with Planning and Zoning Commission and the Citizens Task Force - Planning and Development Services. Mayor DonCarlos presented the agenda item to hold a discussion with City Council, Planning and Zoning Commission, and the Unified Land Development Code Citizen Task Force regarding the draft commercial zoning sections of the Unified Land Development Code. Planning Director, Kelly Carpenter, summarized changes from the previous joint work session and stated the following changes made were: mixed use was changed from extended mixed use; neighborhood serving commercial was changed to neighborhood commercial; specific uses added to the matrix table such as single family use was added to residential: general, big box, and specialty shops are now subsets to retail: bed and breakfast, hotel and motel is a subset of accommodations: clarified a list of uses: moved the conditions from table 1 to table 2: on nonconforming standards, the ability for use variances were removed: and definitions were added. Ms. Carpenter indicated that table 3 is incomplete and requested to Council to do residential standards before adopting the commercial standards. Mr. McCartney requested that Council have the authority to authorize in an appeal process. Ms. Carpenter indicated that by November 1St, information regarding Residential standards will be available and requested that P &Z start looking at the matrixes, conditions and definitions for commercial. Mayor DonCarlos indicated that P & Z would finish the last piece of commercial property which is development standards and Mr. Carnes requested the City staff to recommend the residential data and give P & Z a base line. During discussion, all agreed to submit for approval that if a structure is over 50% damaged, it is authorized to build in the same footprint as previous building but not to expand and to be noted and referenced to under districts. Ms. Carpenter stated that she would present for the next discussion a comparison on how variances work in the code today regarding the hardship and the improvement it has on the citizens. Mr. Haarmeyer stated that this recommendation addresses an addition to an existing facility and not restoring a facility in which Mr. McDonald refers to. He also stated his concern regarding permits being issued in a timely manner and recommended having a log sheet to track the permit process. Mr. Caskey stated that the ad hoc committee selected a group to address this concern. Mr. Gilbert indicated that there are still areas of concern in the apartment and manufactured home standards, as well as part of the commercial standards regarding signs and landscaping which requires time. He also recommended a creation of a coastal zone. Page 3 of 3 Minutes of the May 27, 2010 City Council Joint Work Session Mr. Carnes stated that some of his concerns are: flexibility in permitting and zoning, help small businesses in this community, non conformity issues, and permitting issues and recommends that a system be in place within the staff to predict future issues. Mayor DonCarlos stated that in summary that Ms. Carpenter will have a major portion of the work done by November, P& Z will be working on the quality of development standards for commercial uses which will include the rebuilding footprint, and staff will work on residential standards as well as the blueprint on mapping to present to ULDC. Mayor DonCarlos recommended with consensus from Council that once ULDC receives consensus on the commercial standards that they pass them on to P &Z. Mr. McCartney asked when will the overlay district be put in place and what changes were made to the NSC. Ms. Carpenter staled that her census regarding the overlay district was after the uses work was adopted and mapped and that the name and how NSC related to the materials and collectors fees were changed. Ms. Carpenter also stated that a draft of the downtown district can be done by spring. 2. ADJOURN Mayor DonCarlos adjourned the May 27, 2010, City Council Regular Work Session at 5:20 P.M.
