2010 06 29 FCPEMSD MinutesMINUTES OF THE REGULAR MEETING OF THE BOARD OF DIRECTORS OF THE BAYTOWN FIRE CONTROL, PREVENTION AND EMERGENCY MEDICAL SERVICES DISTRICT June 29, 2010 The Board of Directors of the Baytown Fire Control, Prevention and Emergency Medical Services District (FCPEMSD) met in a Regular Meeting on Tuesday, June 29, 2010 at 4:32 P.M., in the Council Chamber of the Baytown City Hall, 2401 Market Street, Baytown, Texas with the following in attendance: John Adkins Lovella Desormeaux Ryan Hightower Brenda Smith Earl A. President Watts convened the June 29, 2010, FCPEMSD Board Regular Meeting with a quorum present at 4:32 P.M. 1. MINUTES a. Approve the Minutes of the Fire Control, Prevention and Emergency Medical Services District (FCPEMSD) Regular Meeting on April 27, 2010. A motion was made by Director Wurzbach, and seconded by Director Adkins approving the minutes from the April 27, 2010, FCPEMSD Board Regular Meeting. The vote was as follows: Ayes: Directors: Adkins, Baldwin, Desormeaux, Hightower, Wurzbach and President Watts Nays: None Abstained: Director Smith Page 2 of 5 Minutes of the June 29, 2010 FCPEMSD Board Regular Meeting 2. DISCUSSION a. Discuss 2010 -11 Baytown Fire Control, Prevention, and EMS District Proposed Budget and Budget Process - Fire, Health and Finance. City Manager, Garry Brumback presented the agenda item and stated that a notice of public hearing will be published at least 10 days prior to the suggested public hearing date of July 20, 2010. This is the same date recommended for the Board to adopt the budget so that it can be submitted to City Council for consideration. The City Council will also hold a public hearing on the proposed budget and must adopt it at least 30 days before the beginning of the fiscal year. During the discussion Mr. Leiper clarified that due to some legal requirements, the interim board members had agreed to pay for radios that replace analog with digital equipment; this cost is an ongoing one. Mr. Leiper also stated that in the last year two funds had been set aside to allow for the accrual of enough monies to allow for the construction on the fire training facility to begin. Fire Chief, Shon Blake stated that the construction process is ready to begin as soon as the current proposed budget is approved. b. FCPEMSD Continuation Election - Legal. City Manager, Garry Brumback presented the update on the Baytown Fire Control, Prevention, and Emergency Medical Services District continuation election. Mr. Brumback discussed the process for the election as such: (1) the Board will call the continuation election on its own motion by a majority vote on the January 18, 2011; (2) the following month, the discussion and approval of the terms, the judges and judge alternates will take place; (3) the Board must declare a notice of election to the county clerk and voter's registrar; (4) request pre - clearance of election from the Department of Justice; (5) mail ballot applications are sent out; (6) a notice is posted in April; (7) May 2, 2010 is the first day of early voting in person; and (8) the election will be held on May 14, 2011. C. Emergency Medical Services Update - Health and EMS. Mr. Dana Dalby presented the Emergency Medical Services update and stated that due to the Chevy Chassis vehicle being discontinued, the next purchase was for a Dodge that has an expected delivery date of October 2010. Chief Blake and Mr. Bill Baylis stated that the fire training facility is in its first stage and presented a general update on the facility. Director Hightower suggested making the drive entrance straight instead of circular. Page 3 of 5 Minutes of the June 29, 2010 FCPEMSD Board Regular Meeting 3. PROPOSED RESOLUTIONS a. Call a Public Hearing for the FCPEMSD 2010 -11 Proposed Budget - Finance. City Manager, Garry Brumback presented the agenda item and stated that Resolution No. 11 calls for a public hearing regarding the Baytown Fire Control, Prevention, and Emergency Medical Services District 2010 -11 Proposed Budget for July 20, 2010, at 4:30 P.M in the City Council Chamber of Baytown City Hall. Notice of the Public Hearing will be published in the Baytown Sun on July 09, 2010. A motion was made by Director Smith, and seconded by Director Desormeaux approving Resolution No. 11. The vote was as follows: Ayes: Directors: Adkins, Desormeaux, Hightower, Smith, Wurzbach and President Watts Nays: None The motion carried RESOLUTION NO. 11 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT ESTABLISHING THE DATE, TIME AND PLACE FOR A PUBLIC HEARING ON THE 2010 -11 PROPOSED BUDGET; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. b. Baytown Fire Control, Prevention, and EMS District's Investment Policy and Strategy - Finance. City Manager, Garry Brumback presented the agenda item and stated that Resolution No. 12 adopts the Baytown Fire Control, Prevention, and Emergency Medical Services District's Investment Policy and Strategy in compliance with the Public Funds Investment Act Section 2256 -005 (e) & 2256 -005 (f). The changes to the policy are as follows: Authorized Investment Officials and the Statement of Ethics and Conflicts of Interest with the names of the new authorized investment officials: Cynthia Pearson, City of Baytown Director of Finance Margie Grimes, City of Baytown Assistant Director of Finance Genie Ginzel, City of Baytown Treasurer Page 4 of 5 Minutes of the June 29, 2010 FCPEMSD Board Regular Meeting A motion was made by Director Wurzbach, and seconded by Director Adkins approving Resolution No. 12. The vote was as follows: Ayes: Directors: Adkins, Desormeaux, Hightower, Smith, Wurzbach and President Watts Nays: None The motion carried RESOLUTION NO. 12 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT ADOPTING THE BAYTOWN FIRE CONTROL, PREVENTION, AND EMERGENCY MEDICAL SERVICES DISTRICT'S INVESTMENT POLICY; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 4. BUSINESS ITEMS a. Set Next FCPEMSD Meeting - Secretary. A motion was made by Director Smith, seconded by Director Hightower scheduling the next meeting for July 20, 2010 at 4:30 P.M in the Baytown City Council Chamber. Ayes: Directors: Adkins, Desormeaux, Hightower, Smith, Wurzbach and President Watts Nays: None The motion carried. 5. MANAGER'S REPORT a. Receive Sales Tax Report as of June 30, 2010 - Finance. Finance Director, Cynthia Pearson presented the update on the Baytown Fire Control, Prevention, and Emergency Medical Services District's Sales Tax Report as of June 30, 2010 and stated that the percentage collected reflected the same as last year and although taxes are down there is no concern at this time.
