Ordinance No. 12,697ORDINANCE NO. 12,697 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ESTABLISHING MAXIMUM PRIMA FACIE SPEED LIMITS FOR MOTOR VEHICLES IN DESIGNATED SCHOOL ZONES AND PROVIDING FOR HOURS OF ENFORCEMENT ON SCHOOL DAYS OR WHEN CHILDREN ARE PRESENT; AUTHORIZING AND DIRECTING THE PLACEMENT OF SIGNS BY THE DIRECTOR OF PUBLIC WORKS; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO /100 DOLLARS ($200.00); AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. ********************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** WHEREAS, pursuant to Section 545.356 of the Texas Transportation Code, authorizing alteration of maximum prima facie speed limits with respect to highways or portions thereof within the corporate limits of the City of Baytown based upon engineering and traffic investigations and requested public hearings; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That a special hazard exists to traffic safety in the vicinity of elementary schools, junior high schools, senior high schools, and other student attended facilities within the corporate limits of the City of Baytown on days when schools are in session and at times when students and other traffic approach from and depart from the vicinity of such schools and facilities and the City Council hereby makes such findings and determines and declares that the maximum prima facie speed limits to be reasonable, prudent and lawful are as follows at the time and places herein described: Street Limits School Extending from 700 feet north of the intersection of North Main Street at Archer N. Main Road to 2,000 feet north of the intersection of Alamo Elementary School North Main Street at Archer Road, for a total distance of 1,300 feet. j THE ELEMENTARY SCHOOL SPEED ZONE BETWEEN THE HOURS OF 7:15 A.M. AND 8:15 A.M. AND BETWEEN THE HOURS 01---'):')0 P.M. AND 3:30 P.M. SHALL BE 35 MILES PER HOUR UPON THE FOLLOWING STREET LOCATION: Extending • 'll feet north of intersection of • at Devinwood Drive to • 411 feet south of • of 4• at Clark Elementary School Devinwood Drive, for a total distance of 800 THE ELEMENTARY SCHOOL SPEED ZONE BETWEEN THE HOURS OF 7:15 A.M. AND 8:15 A.M. AND BETWEEN THE HOURS OF 2:30 P.M. AND 3:30 P.M. SHALL BE 20 MILES PER HOUR UPON THE FOLLOWING STREET LOCATION: Cedar Bluff Drive ; Extending • m its intersection with SH 146 Clark Elementary School to its intersection with Cedar Landing Drive Section 2: The Director of Public Works is authorized and directed to place the appropriate signs at the locations described in Exhibits "A" and "B." Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or the set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after passage of this ordinance.
