AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE PAYMENT OF EIGHTY -SIX THOUSAND EIGHT HUNDRED
TEN AND 981100 DOLLARS ($86,810.98) TO BROOKSIDE EQUIPMENT SALES
THROUGH THE HOUSTON - GALVESTON AREA COUNCIL FOR THE PURCHASE OF
A JOHN DEERE 997 COMMERCIAL FRONT MOWER WITH 72 INCH MOWING
DECK, A JOHN DEERE 5100M UTILITY TRACTOR WITH CAB AND A JOHN DEERE
CX15 FLEX -WING ROTARY CUTTER FOR THE PARKS AND RECREATION
DEPARTMENT; MAKING OTHER PROVISIONS RELATED THERETO; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement which
authorizes the Houston - Galveston Area Council to take bids for certain items on behalf ofthe City of Baytown;
and
WHEREAS, pursuant to such agreement, the Houston - Galveston Area Council has taken bids for a
John Deere 5100M Utility Tractor with cab and a John Deere 997 Commercial Front mower with 72 inch
mowing deck, a John Deere CX 15 Flex -Wing rotary cutter for the Parks and Recreation Department; NOW
THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby authorizes the payment of
EIGHTY -SIX THOUSAND EIGHT HUNDRED TEN AND 98/100 DOLLARS ($86,810.98) to Brookside
Equipment Sales through the Houston - Galveston Area Council for the purchase of a John Deere 997
Commercial Front mower with 72 inch mowing deck, a John Deere 5100M Utility Tractor with cab and a John
Deere CX15 Flex -Wing rotary cutter for the Parks and Recreation Department.
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated
§252.048, the City Manager is hereby granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTY THOUSAND AND NO /100 DOLLARS ($50,000.00) or less,
provided that the original contract price may not be increased by more than twenty-five percent (25 %) or
decreased by more than twenty-five percent (25 %) without the consent of the contractor to such decrease.
Section 3: This ordinance shall take effect October 1, 2014, after its sage by the City Council
of the City of Baytown. r,/,��
