BAWA Resolution No. 2014-17RESOLUTION NO. 2014-17 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER AUTHORITY AUTHORIZING PAYMENT IN THE AMOUNT OF SIXTY -NINE THOUSAND NINE HUNDRED SEVENTY -NINE AND NO /100 DOLLARS ($69,979.00) TO EVOQUA WATER TECHNOLOGIES LLC, FOR THE PURCHASE OF A CHAIN AND SCRAPER TO REMOVE THE SLUDGE FROM THE BOTTOM OF THE SEDIMENTATION BASIN AT THE BAYTOWN AREA WATER AUTHORITY TREATMENT PLANT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ********************************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** WHEREAS, state law provides that when the functional requirements of the Baytown Area Water Authority can only be satisfied by one source, the requirement for competitive bids is not applicable; and WHEREAS, the procurement of a chain and scraper to remove the sludge from the bottom of the sedimentation basin at the Baytown Area Water Authority Treatment Plant can be satisfied by only one source, Evoqua Water Technologies LLC; NOW THEREFORE; BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER AUTHORITY: Section 1: That the Board of Directors of the Baytown Area Water Authority hereby declares that only one source can satisfy the needs of the Baytown Area Water Authority for a chain and scraper to remove the sludge from the bottom of the sedimentation basin at the Baytown Area Water Authority Treatment Plant. Section 2: That the Board of Directors of the Baytown Area Water Authority authorizes payment of the sum of SIXTY -NINE THOUSAND NINE HUNDRED SEVENTY -NINE AND N01100 DOLLARS ($69,979.00) to Evoqua Water Technologies LLC, as the sole source, for the purchase of a chain and scraper to remove the sludge from the bottom of the sedimentation basin at the Baytown Area Water Authority Treatment Plant. Section 3: That the General Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO/] 00 DOLLARS ($50,000.00) or less, provided that the original contract price may not be increased by more than ten percent (10 %) or decreased by more than ten percent (10 %) without the consent of the contractor to such decrease. Section 4: This resolution shall take effect immediately from and after its passage by the Board of Directors of the Baytown Area Water Authority.
