2003 01 09 WS MinutesMINUTES OF THE WORK SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN January 9, 2003 The City Council of the City of Baytown, Texas, met in work session on January 9, 2003, at 5:40 p.m. in the Hullum Conference Room of Baytown City Hall, 2401 Market Street, Baytown, Texas, with the following in attendance: Ronnie Anderson Coleman Godwin Don Murray Mercedes Renteria III Scott Sheley Pete C. Alfaro Bob Leiper Ignacio Ramirez, Sr. Gary W. Smith Absent was: Calvin Mundinger Council Member Council Member Council Member Council Member Council Member Mayor Assistant City Manager City Attorney City Clerk Council Member The meeting was opened with a quorum present after which the following business was conducted: Discuss proposed voting plan for the City of Baytown. Assistant City Manager Bob Leiper stated that on December 11, 2001 City Council adopted a voting plan for the City. It was submitted to the Department of Justice, but due to concerns about the Hispanic population in District 2 and after consultation with representatives from the Department of Justice and our demographers, the plan was withdrawn. The new plan was developed after further discussions. The new plan has only minor changes to the boundary line between District 2 and District 6. City Clerk Gary Smith described the boundary line changes. The new line begins at the intersection of South Main and Alexander Drive, proceeds east on Alexander to the railroad track, north on the railroad track to South Main, north on South Main to East Republic, east on East Republic to Seventh Street, north on Seventh Street to Defee, east on Defee to North Alexander, north on North Alexander to East Fayle, west on East Fayle to North Main, north on North Main to Hafer, and east on Hafer to the railroad track. In response to an inquiry from Council Member Renteria, City Attorney Ignacio Ramirez informed Council that the new plan does not have the same Hispanic population in District 2 that the original plan had under the 2000 census, but the new plan lessens the retrogression and is within a range that is normally acceptable in redistricting. Council Member Sheley encouraged Council to be vigilant for changes in population after annexations and other developments and be willing to modify the plan as annexations and growth occur. Mr. Ramirez explained that any change that affected the voting plan, including annexations, must be approved by the Department of Justice. Mr. Leiper reminded City Council that the proposed amendments to the carnival ordinance were last reviewed by City Council on November 14, 2002. At that meeting the issues of exemptions for non - profit organizations and the location of the events were raised. In response to the request, staff added an exemption for non -profit organizations and removed the requirement that the event must be held on the grounds of the non - profit organization. However, the non - profit must have an agreement with the property owner to conduct the event on the property. Under the proposed amendments, a non -profit must be organized under Texas law or as a 501(c)(3) under federal tax law. Discuss appointments. Baytown Area Community Long Range Planning Commission. Mayor Alfaro noted that one member had attended only one of the meetings. Council Member Murray stated that he would move reappointment of all members except Kenneth Roach. Council Member Sheley stated that he would talk to Mr. Roach about his intentions to serve on the Commission. Growth Management and Development Advisory Commission and Planning and Zoning Commission. The Council discussed the possibility of conflicts of interest for Glen Angel and the business of the Commissions. Council Member Anderson said that he would discuss the concerns with Mr. Angel. Council Member Shelley stated that he would move reappointment of all members except Glen Angel. Adjourn. There being no further business, Council Member Murray moved adjournment. Council Member Godwin seconded the motion. The vote follows: Aye: Council Members Anderson, Godwin, Murray, Renteria, and Sheley Mayor Alfaro. Nay: None.
