Tile City Council of the City of Baytown, Texas, met in a Regular Meeting on Thursday, June
26, 2014, at 6 :30 P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street,
Baytown, Texas with the following in attendance:

Mayor DonCarlos convened the June 26, 2014, City Council Regular Meeting with a quorum
present at 6 :30 P.M., all members were present with the exception of Council Member Terry
Sain who was absent.
Pledge of Allegiance, Texas Pledge, and invocation was led by Council Member McCartney.
1. MINUTES
a. Consider approving the minutes of the City Council Regular Meeting held on May
22, 21114.
A motion was made by Council Member Robert C. Hoskins and seconded by Council Member
Brandon Capetillo approving the May 22, 2014, City Council Regular Meeting; minutes. The
vote was as follows:

b. Present a proclamation designating the month of July as Fair Housing Month in the

Public Affairs Coordinator, Patti Jett presented the agenda item and Mayor DonCarlos presented
to June Tyler and members of the CDAC a proclamation designating the month of July as Fair
Housing Month in the City of Baytown.
3. REZONING OF 111.82 ACRES OF LAND
a. Consider an ordinance for the second and final reading for a voluntary annexation
of approximately 114.795 acres of land situated in the Talcott Patching Survey, Abstract
620, Harris County, Texas, located at the northwest corner of Wallisville and Garth Roads.
b. Consider an ordinance placing the property annexed into the City of Baytown in the
previous agenda item and being described as approximately 114.795 acres of land generally
located at the northwest intersection of Garth and Wallisville Roads into Council District
No. 3.
Planning and Development Director, Tiffany Foster presented the agenda item and requested to
summarize items 3.a., 3.b., 3.c., and 3.d. together as they are all related. She stated that
Ordinance No. 12,548 is the second and final reading for the voluntary annexation of land
commonly known as MUD 213B. She stated that the intended use of the land is for
approximately five (5) acres of commercial development on the corners of Wallisville and Garth
Road and for a single family residential subdivision of close to 490 to 500 homes. Additionally,

she stated that this item includes approximately 2.975 acres of Wallisville Road right -of -way
annexation in addition to the land.
Mrs. Foster stated that agenda item 3.b. places the land itself into Council District 3 and that
agenda item 3.c. will be a public hearing for the rezoning of the property from Open
Space/Recreation (OR) to Single Family 2 Residential, as well as, General Commercial (GC).
She further stated that agenda item 3.d. is the consideration of the rezone.
Mayor DonCarlos stated that agenda items 3.a. and 3.b. would be considered together.

C. Conduct a public hearing concerning an amendment to the official zoning map for
approximately 111.82 acres out of the Talcott Patching Survey, A -620, Harris County,
Texas, located on the northwest corner of the Wallisville and Garth Road, from an Open
Space /Recreation (OR) District to a General Commercial (GC) District and a Mixed
Residential at Low to Medium Densities (SF2) District.
At 6:42 P.M., Mayor DonCarlos opened and conducted a public hearing conceming an
amendment to the official zoning map for approximately 11 1.82 acres out of the Talcott Patching
Survey, A -620, Hams County, Texas, located on the northwest comer of the Wallisville and
Garth Road, from an Open Space/Recreation (OR) District to a General Commercial (GC)
District and a Mixed Residential at Low to Medium Densities (SF2) District.
Deputy City Manager Bottoms stated that this public hearing is in regards to an amendment to
the official zoning map to rezone the land from Open Space/Recreation (OR) to General
Commercial (GC) and SF2.
With there being no one registered to speak, Mayor DonCarlos closed the public hearing at 6:43
P.M.
d. Consider an ordinance amending the official zoning map for a property of
approximately 111.82 acres out of the Talcott Patching Survey, A -620, Harris County,
Texas, located on the northwest corner of the Wallisville Road and Garth Road, from an

4. PROPOSED ORDINANCES
a. Consider an ordinance authorizing Amendment No. 7 to the Interlocal Agreement
with Harris County for Circulator Bus Service in the City of Baytown.
Deputy City Manager Bottoms presented the agenda item and stated that this amendment is the
annual renewal of the Circulator Bus Service which includes expanding the hours of operations
from 6:00 A.M. to 7:00 P.M. on a trial basis. He stated that the continuance of the extended
hours depends on the number of participants that will utilize the service. He stated that there are
approximately 5,000 to 6,000 riders per month.

b. Consider an ordinance accepting the donation of a 10.95 acre tract of land located
on Kilgore Road, Harris County, Texas, from D.G.M., Inc., for municipal purposes.
Parks and Recreation Director, Scott Johnson presented the agenda item and stated that
Ordinance No. 12,571 accepts the donation of 10.95 acres of land located on Kilgore Road,
about half of a mile north of Roseland Park on Cedar Bayou from D.G.M., Inc., for municipal
purposes. He stated that there are no immediate plans or funding for development of this
property. He further stated that the elevation level of this property is low; resulting in limited
development opportunities; but it will provide access to Cedar Bayou for future generations. He
stated that as with many of park land acquisitions, such as Eddie Huron Park, it could provide
park growth and development opportunities at some point in the future. Additionally, he stated
that the donation was discussed by the Baytown Parks and Recreation Advisory Board at their
monthly meeting on June 04, 2014, and it voted unanimously to recommend to council to accept
the donation.

5. PROPOSED RESOLUTIONS
a. Consider a resolution granting the petition of Nasir Panjwani for the annexation of
approximately 81.5 acres of land situated in the George Ellis Survey, Abstract 21, Harris
County, Texas, north of 1 -10 an Wallisville Road between N. Main Street and Sjolander
Road.
Mrs. Foster presented the agenda item and stated that this property is approximately 81 acres of
land along Wallisville Road east of North Main Street. She stated that there is a proposed
residential development of approximately 300 homes, as well as, five (5) to six (6) acres for

commercial on the front of Wallisville Road. She further stated that Resolution No. 2315
authorizes staff to prepare a service plan for the area to be annexed into the City.

6. REPORTS
a. Receive a report from the Economic Development Alliance regarding Year One of
the Economic Development Services Agreement for Tourism and Promotional Services
2013 -2016.
Mr. Chad Burke, President/CEO of the Economic Development Alliance presented the report to
the Mayor and City Council regarding Year One of the Economic Development Services
Agreement for Tourism and Promotional Services 2013 -2016. He stated that their goal is to
develop the economy through economic development and quality of life work. He stated that the
San Jacinto Texas Historic District was created through the Economic Alliance to help beautify
the area and to promote tourism and history in the area. He stated that some of the projects
included epic art on tanks, community gateway projects, and corridor standards projects.

b. Consider an ordinance authorizing an interlocal agreement with the Baytown
Municipal Development District for funding inspection fees associated with the Traffic
Signal and Mitigation Agreement with TRAAZ Properties, LLC, and BCHPW
Development LP.
Council Member Presley requested a summary of the inspection fees. Deputy City Manager
Bottoms stated that a 300 home subdivision is being built on Hutto and Rollingbrook on the
south side of Rollingbrook. He stated that the City requested that the developer provide dual
access on Rollingbrook to the subdivision and in doing so, it was identified that the access road
to the subdivision goes over a pipeline. He stated that ExxonMobil was contacted by the
developer and gave them an estimate letter of $100,000 for inspection fees to make sure that the
pipeline wasn't damaged as part of the road construction. He further stated that the item is a
request to reimburse the developer 50% of the inspection fee cost with MDD agreeing as well.
Deputy City Manager Bottoms stated that the actual charge will not be known until the street is
being put in. He stated that the developer will pay the cost and once the project is complete, will
then be reimbursed. Additionally, he stated that the most that the MDD would reimburse would
be $50,000.
During further discussion, Ajay Shakyaverk, Assistant Director of Engineering stated that the

developer has provided the drawings to connect the roadway. He stated that they have plans and
profiles of the proposed roadway over the pipelines and that is what the fees are based on.

TEXAS, AUTHORIZING THE PAYMENT IN AN AMOUNT NOT TO
EXCEED THREE HUNDRED NINETY -NINE THOUSAND NINE HUNDRED
FIFTEEN AND 20/100 DOLLARS ($399,915.20) TO IPR SOUTH CENTRAL,
LLC, THROUGH THE HOUSTON - GALVESTON AREA COUNCIL FOR THE
ALLENBROOK SECTION 1 SANITARY SEWER REHABILITATION
PROJECT; AUTHORIZING AN END USER AGREEMENT; MAKING

d. Consider an ordinance approving budget amendments to the Baytown Crime
Control and Prevention District's Fiscal Year 2013 -14 budget in order to reprogram funds
from Unforeseen/New Initiatives and Working Capital - Ending to (1) Personnel for the
salaries and associated benefits of fifteen (15) police personnel, (2) Machinery and
Equipment for the purchase of twenty (20) trunk lock vault boxes for Police Patrol Tahoes,
and (3) Machinery and Equipment for the purchase of CopLogic, an online reporting
system for the Police Department.

W. James Street.
ORDINANCE NO. 12,576

TEXAS, AWARDING THE CONTRACT FOR THE HOUSING
RECONSTRUCTION PROJECT LOCATED AT 220 W. JAMES STREET TO
MLG CONSTRUCTION INC., FOR THE SUM OF FIFTY -THREE
THOUSAND FOUR HUNDRED SEVENTY -FOUR AND NO /100 DOLLARS
($53,474.00); AUTHORIZING PAYMENT THEREOF; AND PROVIDING

8. APPOINTMENTS
a. Conduct the election of the Baytown City Council Mayor Pro Tem.
Mayor DonCarlos stated that Council Member Mercedes Renteria III is the next Council
Member for consideration and he shall serve for six months, beginning July 01, 2014 and ending
on December 31, 2014.

Brandon Capetillo approving the appointment of Mercedes Renteria III as Mayor Pro Tem. The

b. Consider three (3) appointments to the Cedar Bayou Navigation District's Devil's
Elbow Committee.
The Navigation District Board (the "District ") has given its Chair Calvin Mundinger approval to
form a group of area stakeholders to develop ideas concerning the future of the Devil's Elbow.
Mr. Mundinger stated that an Island (approximately 70 acres) will be created after the dredging
project completes the new alignment of the main bayou, but that the project is predicated on the
District receiving Federal funding for the dredging. He stated that the District will own the
Island; however, they would request that this new group consider ideas that would be of benefit
to everyone. He stated that there's a possibility to designate the area for recreational use only. He

further stated that the District is asking the City to have three (3) representatives appointed to this
group, and as such, Staff recommends the following individuals: Mr. Billy Barnett, representing
the Parks Board; Ms. Tracey Prothro representing the Parks staff, and Mr. Nick Woolery
representing City Administration. Additionally, he stated that other representatives to this group
include Mr. Guido Perciani who will lead this group, Chambers County, who per Commissioner
Rusty Senate, will appoint a representative, and Ms. Catherine Williams with C H A R T, the
group that spearheaded the barge removal from the Bayou.
Mayor DonCarlos inquired if this would change the county line and will the devil's elbow
portion that's being cut off hold water. Mr. Mundinger stated that the General Land Office would
have to provide the answer regarding the county line, but in regards to the cut of the elbow stated
that in some opinion the water will silt in. Mr. Mundinger further stated that he would hope that
future dredging be done from the marina into the channel and a long tern plan to deal with that
concern would be appropriate. Mr. Mundinger stated that he was in favor of the project and
believes that the cut would lend itself to a safer Bayou. Council Member McCartney inquired of
how much time would be cut off from barge trips. Mr. Mundinger stated that a barge travel time
would be cut down to about 45 minutes one way. Council Member McCartney inquired if any
consideration was given to the concern of tidal Flooding. Mr. Mundinger stated that the Core of
Engineers in their initial study of this cut stated that there was no impact on adverse effect of
flooding. Mr. Mundinger further stated that they requested that the Core of Engineers provide an
update by virtue of Hurricane IKE.
A motion was made by Mayor Pro Tem David McCartney and seconded by Council Member
Mercedes Renteria III approving the appointments of Mr. Billy Barnett, Ms. Tracey Prothro, and
Mr. Nick Woolery to the Cedar Bayou Navigation District's Devil's Elbow Committee. The vote
was as follows:
Ayes: Mayor Stephen DonCarlos, Council Member Brandon Capetillo, Council
Member Robert C. Hoskins, Mayor Pro Tem David McCartney, Council

9. MANAGER'S REPORT
a. Present the 3rd and 4th of July Celebration schedule and entertainment for 2014.
Deputy City Manager Bottoms presented the agenda item and stated that this year's event will
begin on Thursday, July 3rd; with "4 Barrel Ramblers ", "Ryan Guidry", and "Kansas ". He stated
that on July 4th there will be the vendor booths, the parade to start at 5:30 P.M., Breelan Angel,
Montgomery Gentry, and the Fireworks Extravaganza.

It. The Baytown Municipal Development District (MDD) meeting scheduled for
Thursday, July 03, 2014, has been rescheduled to the following Thursday, July 10, 2014, to
accommodate the July 3rd and 4th Celebration.
Deputy City Manager Bottoms stated that the Baytown Municipal Development District (MDD)
meeting scheduled for Thursday, July 03, 2014, has been rescheduled to the following Thursday,
July 10, 2014, at 5:00 P.M., to accommodate the July 3rd and 4th Celebration.
C. City Offices will be closed on Friday, July 04, 2014 in observance of the upcoming
Independence Day Holiday.
Deputy City Manager Bottoms stated that City Offices will be closed on Friday, July 04, 2014,
and that Friday, June 27, 2014 will be the final day to fill the boot for the Firefighters MDA.
Additionally, he stated that there is a discount for those who registration now for Bike around the
Bay.
