BAWA Resolution No. 2014-12RESOLUTION 2014 -12 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER AUTHORITY AUTHORIZING THE FIRST AMENDMENT TO THE PROFESSIONAL SERVICE AGREEMENT WITH JONES AND CARTER, INC., FOR THE BAYTOWN AREA WATER AUTHORITY SIX MILLION GALLON SURFACE WATER TREATMENT PLANT; AUTHORIZING PAYMENT IN AN AMOUNT NOT TO EXCEED THREE MILLION EIGHT HUNDRED EIGHTY -EIGHT THOUSAND THREE HUNDRED EIGHTY AND NO /100 DOLLARS ($3,888,380.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ****************************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER AUTHORITY: Section 1: That the Board of Directors of the Baytown Area Water Authority hereby authorizes the First Amendment to the Professional Service Agreement with Jones and Carter, Inc., for the Baytown Area Water Authority Six Million Gallon Surface Water Treatment Plant. A copy of the amendment is attached as Exhibit "A" and incorporated herein for all intents and purposes. Section 2: That the Board of Directors of the Baytown Area Water Authority hereby authorizes the payment of an amount not to exceed EIGHTY -FIVE THOUSAND NINE HUNDRED EIGHTY -THREE AND NO /] 00 DOLLARS ($85,983.00) to Jones and Carter, Inc., consistent with the Amendment. Section 3: That the General Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO/ 100 DOLLARS ($50,000.00) or less, provided that the original contract price may not be increased by more than ten percent (10 %) or decreased by more than ten percent (10 %) without the consent of the contractor to such decrease. Section 4: This resolution shall take effect immediately from and after its passage by the Board of Directors of the Baytown Area Water Authority.
