2002 05 23 WS Minutes°* MINUTES OF THE WORK SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN May 23, 2002 The City Council of the City of Baytown, Texas, met in work session on May 23, 2002, at 5:40 p.m. in the Hullum Conference Room of Baytown City Hall, 2401 Market Street, Baytown, Texas, with the following in attendance: Ronnie Anderson Council Member Coleman Godwin Council Member Calvin Mundinger Council Member Don Murray Council Member Mercedes Renteria III Council Member Scott Sheley Council Member Pete C. Alfaro Mayor Monte Mercer City Manager Ignacio Ramirez City Attorney Gary W. Smith City Clerk The meeting was opened with a quorum present after which the following business was conducted: Review and discuss proposed Food and Food Service Establishment ordinance. Mike Lester, Director of Health/EMS, reviewed the development of and the proposed Food ordinance. Three public meetings were held to discuss the proposed draft revisions of the local ordinance. The revisions include the adoption of the Texas Food Establishment Rules with local modifications. The first meeting was held on January 16, 2002. A second meeting was held on March 18, 2002 for those who could not attend the first meeting. Based on responses received at the first two meetings, revisions to the proposed ordinance were drafted and presented at a third meeting, held on May 13, 2002. Revisions presented in the final draft included a proposed fee structure that is graduated, based on establishment size and risk factors and the requirement of certified food managers or trained food handlers was redacted to provide flexibility for the needs of the various vendors. The proposed ordinance will be updated to include the 1998 state requirements. The 44- point inspection program will be modified to a 27 -point program and be based more on food handling and hygiene. Some changes in temperature requirements are proposed. The ordinance also proposes increases in fees. When compared to nearby entities, the proposed fees rank seventh of ten. The fees are based on the type of food served, the volume served and the characteristics of the customers. Page 2 of 2 Minutes of the Work Session —May 23, 2002 Mr. Lester responded that the initial concern over the increased fees was lessened after the proposed fees were studied. Fees for non -profit organizations are waived. The department is conducting 3 -4 inspections per week for non - profit organizations. Council Member Godwin urged lower fees. Monte Mercer, City Manager, replied that the proposed fees would cover a portion of the administrative costs of the program. The proposed ordinance will be discussed at a future work session. Discuss appointment of an interim City Manager. City Manager, Monte Mercer, reported that a memorandum had been provided to the Council, along with the resumes of Bob Leiper and Gary Jackson. Each has offered full support if the other is selected. Mr. Jackson has a great deal of experience in city management. Mr. Leiper has great depth of experience with the City. Mayor Alfaro asked if the Council believed it was necessary to appoint an interim city manager. While he had received calls asking Council to consider the appointment of Fritz Lanham, he reported that Mr. Lanham was not interested in the position. Council Member Renteria expressed concern that the interim appointment would give an advantage to that person in the final selection of the city manager. Council Member Sheley observed that in the past, the then - current City Manager remained in place during the selection process. The Council Members generally expressed that Mr. Leiper and Mr. Jackson were both good candidates and that the appointment of an interim would not limit objectivity in the selection of a final candidate. Discuss appointments. Baytown Area Water Authority Board of Adjustment. The Council was not ready to discuss these appointments. Community Development Advisory Committee. Council Member Godwin announced that he was ready with a nomination. Baytown Police Reserve officer. Council Member Sheley stated that he would move approval of Mark Smith's appointment to the Baytown Police Reserve Force. Page 3 of 3 Minutes of the Work Session —May 23, 2002 r` Adjourn.
