2002 05 09 WS MinutesMINUTES OF THE WORK SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN May 9, 2002 The City Council of the City of Baytown, Texas, met in work session on May 9, 2002, at 6:05 p.m. in the Hullum Conference Room of Baytown City Hall, 2401 Market Street, Baytown, Texas, with the following in attendance: Ronnie Anderson Council Member Coleman Godwin Council Member Calvin Mundinger Council Member Don Murray Council Member Mercedes Renteria III Council Member Scott Sheley Council Member Pete C. Alfaro Mayor Monte Mercer City Manager Ignacio Ramirez City Attorney Gary W. Smith City Clerk The meeting was opened with a quorum present after which the following business was conducted: Discuss proposed ordinance amending the carnival ordinance. Assistant City Manager Bob Leiper related that citizens have complained to the city when carnivals are in town. The complaints involve a variety of issues. Significantly, the proposed ordinance prohibits living in the trailers and recreational vehicles on the carnival site. The distance that the carnival is required to be from residential property is increased. The distance proposed is 500 feet from a residence, school or church. The proposed ordinance creates an exemption for a church or school that is holding a short -term carnival. Council Member Murray expressed his opposition to the exception for churches and schools. Responding to other inquiries, Mr. Leiper stated that a definition of "short -term" would be developed. Mayor Alfaro requested that schools, churches and non - profit groups be surveyed to determine the impact of prohibiting carnivals from operating within the city limits. City Attorney Ignacio Ramirez expressed concern about the ability of the City to prohibit carnivals and added that he would research the issue. Members of Council expressed support for a permit fee that recovered all of the City's Page 2 of 2 Minutes of the Work Session —May 9, 2002 expenses related to carnivals. Discuss proposed rules and regulations for the Baytown Nature Center. City Manager Monte Mercer reviewed the proposed rules for the Baytown Nature Center, noting that the rules had been discussed during the work session held on April 11, 2002. No changes had been made to the proposed rules. Discuss appointments. Baytown Area Water Authority Board of Adjustment. The Council was not ready to discuss the appointments. Adjourn.
