AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE PAYMENT IN AN AMOUNT NOT TO EXCEED THREE
HUNDRED NINETY -NINE THOUSAND NINE HUNDRED FIFTEEN AND 20/100
DOLLARS ($399,915.20) TO IPR SOUTH CENTRAL, LLC, THROUGH THE
HOUSTON - GALVESTON AREA COUNCIL FOR THE ALLENBROOK SECTION 1
SANITARY SEWER REHABILITATION PROJECT; AUTHORIZING AN END USER
AGREEMENT: MAKING OTHER PROVISIONS RELATED THERETO; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement which
authorizes the Houston - Galveston Area Council to take bids for certain items on behalf of the City of Baytown;
and
WHEREAS, pursuant to such agreement, the Houston - Galveston Area Council has taken bids for
trenchless pipeline rehabilitation projects, such as the City of Baytown's Allenbrook Section 1 Sanitary Sewer
Rehabilitation Project; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby authorizes the payment to IPR
South Central, LLC, in an amount not to exceed THREE HUNDRED NINETY -NINE THOUSAND NINE
HUNDRED FIFTEEN AND 20/100 DOLLARS ($399,915.20) based upon the lump sum and /or unit prices
obtained through the Houston- Galveston Area Council's Contract for Trenchless Pipeline Rehabilitation
Services for the City of Baytown's Allenbrook Section 1 Sanitary Sewer Rehabilitation Project. The City
Manager and the City Clerk are hereby authorized and directed to execute and attest to an End User Agreement
for the above - referenced project; said agreement containing, plans, specifications and requirements of the
City's engineer and appropriate bond requirements in accordance with the provisions of Texas Government
Code, Chapter 2253
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated
§252.048, the City Manager is hereby granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTY THOUSAND AND NO /100 DOLLARS ($50,000.00) or less,
provided that the original contract price may not be increased by more than twenty-five percent (25 %) or
decreased by more than twenty-five percent (25 %) without the consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately from a after its passage by the City
Council of the City of Baytown.
