AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING THE PAYMENT OF ONE HUNDRED THIRTY -ONE
THOUSAND FOUR HUNDRED SEVENTY -SEVEN AND 53/100 DOLLARS
($131,477.53) TO GENERAL CONTRACTOR SERVICES, INC., THROUGH
FEDERAL SUPPLY SCHEDULE 84 OF THE UNITED STATES GENERAL
SERVICES ADMINISTRATION FOR HYDRO -STOP ROOFING PROJECT AT THE
BAYTOWN JAIL; AUTHORIZING A CONTINGENCY ALLOWANCE IN THE
AMOUNT OF FORTY THOUSAND AND NO /100 DOLLARS ($40,000.00);
MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR
THE EFFECTIVE DATE THEREOF.

WHEREAS, the Local Preparedness Acquisition Act (P.L. 110 -248) amended the Federal
Property and Administrative Services Act to authorize the use of Federal Supply Schedule 84 contracts
by state and local entities under the GSA Cooperative Purchasing Program; and
WHEREAS, based upon the Act, the City of Baytown qualifies as a local government entity and
is qualified to participate in the GSA Cooperative Purchasing Program as an alternative purchasing
method satisfying the City's competitive bidding obligations; and
WHEREAS, the materials and services for the Hydro -Stop Roofing Projects at the Baytown Jail
may be purchased by the City through the Cooperative Purchasing Program of the United States General
Services Administration; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby authorizes the payment of
ONE HUNDRED THIRTY -ONE THOUSAND FOUR HUNDRED SEVENTY -SEVEN AND 53/100
DOLLARS ($131,477.53) to General Contractor Services, Inc., through the Federal Supply Schedule
84 of the United States General Services Administration for Hydro -Stop Roofing Projects at the
Baytown Jail.
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated
§252.048, the City Manager is hereby granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTY THOUSAND AND NO /100 DOLLARS ($50,000.00) or less,
provided that the original contract price may not be increased by more than twenty -five percent (25 %)
or decreased by more than twenty -five percent (25 %) without the consent of the contractor to such
decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
