Ordinance No. 12,551ORDINANCE NO. 12,551 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, CLOSING E. LOBIT AVENUE AT N. MAIN STREET AND W. LOBIT AVENUE AT N. MAIN STREET IN CONJUNCTION WITH THE ESTABLISHMENT OF A DOWNTOWN RAILROAD QUIET ZONE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. *********************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** WHEREAS, the City desires to create a downtown quiet zone where train operators will not be allowed to sound their horns unless there is an emergency or imminent safety; and WI IEREAS, the creation of a quiet zone will improve the quality of life within the downtown area, will reduce adverse health impacts caused by train horns (e.g., an interruption in sleep patterns), and encourage development and redevelopment along the affected train track; and WHEREAS, to create a quiet zone, the Federal Railroad Administration requires that supplemental safety measures be implemented to overcome the additional risks that might result from silencing a train horn; and WHEREAS, closing E. Lobit Avenue and W. Lobit Avenue at their intersections with N. Main Street eliminates certain railroad safety risks associated with the railroad tracks on N. Main Street between such avenues; and WHEREAS, the City Council hereby finds that the interest of the public will be benefitted by the closure of E. Lobit Avenue and W. Lobit Avenue at their intersections with N. Main Street; and WHEREAS, the City Council hereby finds that neither the owners of property adjacent to said streets nor the public in general will be prejudiced or impaired by the closure of E. Lobit Avenue and W. Lobit Avenue at their intersections with N. Main Street; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That all matters and facts set forth in the recitals hereinabove are found to be true and such recitals are hereby approved and made a part of this ordinance for all purposes and are adopted as a part of the judgment and findings by the City Council of the City of Baytown, Texas. Section 2: That in conjunction with the creation of a downtown quiet zone, the City Council of the City of Baytown, pursuant to its authority granted in Section 311.007 of the Texas Transportation Code and Section 6 of the Charter of the City of Baytown, Texas, hereby authorizes the closure of E. Lobit Avenue and W. Lobit Avenue at their intersections with N. Main Street as depicted in Exhibit "A," which is attached hereto and incorporated herein for all intents and purposes. Section 3: The Director of Public Works is directed to cause placement of appropriate barricades, signage and other traffic control devices and to take all further action necessary for the closures authorized in Section 1 hereof at the time the downtown quiet zone is implemented. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
