A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE CITY MANAGER TO SUBMIT A NOTICE OF INTENT TO
CREATE A DOWNTOWN QUIET ZONE IN THE CITY OF BAYTOWN IN
ACCORDANCE WITH THE REGULATIONS OF THE FEDERAL RAILROAD
ADMINISTRATION, DEPARTMENT OF TRANSPORTATION; AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes the City
Manager to submit a notice of intent to create a downtown quiet zone in the City of Baytown in
accordance with 49 C.F.R. §222.43 and other applicable regulations in order to impose a 24-hour
restriction on the routine sounding of locomotive horns within the proposed zone, which is depicted in
Exhibit "A," which is attached hereto and incorporated herein for all intents and purposes.
Section 2: That the City Manager is hereby designated as the authorized representative for
all purposes concerning the creation of the above -referenced quiet zone and is authorized to take further
actions necessary for the creation of such zone, including, but not limited to, the issuance of a notice of
quiet zone establishment and the submission of periodic updates pursuant to the applicable regulations of
the Federal Railroad Administration.
Section 3: This resolution shall take effect immediately from and after its passage by the City
Council of the City of Baytown, Texas.
