HomeMy WebLinkAboutOrdinance No. 16,574 (Item 7.u)ORDINANCE NO. 16,574 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING A CONSTRUCTION CONTRACT WITH CARTER CONSTRUCTION, LLC. IN AN AMOUNT NOT TO EXCEED TWENTY-TWO MILLION, EIGHT -HUNDRED, SEVENTY-THREE THOUSAND, EIGHT - HUNDRED, FORTY-EIGHT DOLLARS AND 35/100 ($22,873,848.35) FOR THE MARKET STREET REVITALIZATION PROJECT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, The Market Street Revitalization Project ("Project) was advertised on May 5 and May 129 2026; and WHEREAS, six bids were received and publicly opened on June 5, 2026, at 11:15AM; and WHEREAS, bids received ranged from TWENTY-TWO MILLION, EIGHT -HUNDRED, SEVENTY-THREE THOUSAND, EIGHT -HUNDRED, FORTY-EIGHT DOLLARS AND 35/100 ($22,873,848.35) to TWENTY-FIVE MILLION, NINE -HUNDRED, SIXTY-EIGHT THOUSAND, THREE -HUNDRED, SIXTEEN DOLLARS AND 95/100 ($25,968,316.95); and WHEREAS, Carter Construction, LLC. submitted the lowest responsive bid providing the best value to the City; and WHEREAS, staff concurs with the Engineer's recommendation to award the contract to Carter Construction, LLC.; and WHEREAS, the Project is funded in part through the Texas General Land Office Community Development Block Grant — Disaster Recovery Reallocation Program (CDBG-DRRP), which will provide FIFTEEN MILLION DOLLARS AND NO/100 ($15,000,000) for construction and Harris County Flood Control District will contribute an additional THREE MILLION, SEVEN -HUNDRED, ONE DOLLARS AND 53/100 ($3,701,043.53) through an existing Interlocal Agreement, with the City responsible for the remaining project costs; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes and directs the City Manager to execute and the City Clerk to attest to a Construction Contract with Carter Construction, LLC. for the Market Street Revitalization Project. A copy of said agreement is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes. Section 2: That the City Council of the City of Baytown authorizes payment to Carter Construction, LLC. in an amount not to exceed TWENTY-TWO MILLION, EIGHT -HUNDRED, SEVENTY-THREE THOUSAND, EIGHT -HUNDRED, FORTY-EIGHT DOLLARS AND 35/100 ($22,873,848.35) in accordance with the agreement authorized in Section 1 hereinabove. Section 3: That pursuant to the provisions of Texas Local Government Code Annotated §252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO/ 100 DOLLARS (S50,000.00) or less, provided that the original contract price may not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
