AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING PAYMENT IN AN AMOUNT NOT TO EXCEED SIXTY
THOUSAND AND 00/100 DOLLARS ($60,000.00) PER YEAR FOR YEAR ONE OF
A THREE-YEAR SERVICE AGREEMENT WITH FRONTIER COMMUNICATIONS
OF AMERICA, INC. TO PROVIDE INTERNET CONNECTIVITY SUPPORTING
CITY FACILITIES THROUGH THE INTERLOCAL PURCHASING SYSTEM (TIPS),
CONTRACT NO. 220105; MAKING OTHER PROVISIONS RELATED THERETO;
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement or
membership for cooperative purchasing with the Interlocal Purchasing System (TIPS); and
WHEREAS, pursuant to such agreement, the City may make purchases based upon the bids received
and the negotiated contract entered into by Interlocal Purchasing System (TIPS); and
WHEREAS, the Interlocal Purchasing System (TIPS) has taken bids and entered into a contract for
internet connectivity products and services; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby authorizes the payment to Frontier
Communications of America, Inc. in an amount not to exceed SIXTY THOUSAND AND 00/100
DOLLARS ($60,000.00) per year for year one of a three-year service agreement with Frontier
Communications, a Verizon Company, to provide internet connectivity supporting City facilities.
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated Section
252.048, the City Manager is hereby granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTY THOUSAND AND NO/100 DOLLARS ($50,000.00) or less,
provided that the original contract price may not be increased by more than twenty-five percent (25%) or
decreased by more than twenty-five percent (25%) without the consent of the contractor to such Decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
