HomeMy WebLinkAboutOrdinance No. 16,553 (Item 5.c.)ORDINANCE NO. 16,553 AN ORDINANCE OF THE CITY OF BAYTOWN, TEXAS, AMENDING THE COMPREHENSIVE PLAN 2040, BAYTOWN, TEXAS, "REVISING THE FUTURE LAND USE PLAN LOCATION CRITERIA LARGE SCALE COMMERCIAL, LIGHT INDUSTRIAL, HEAVY INDUSTRIAL, AND THE FUTURE LAND USE MAP NOTES" AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 2: That Comprehensive Plan 2040 "Future Land -Use," Large Scale Commercial and Industrial, "Location Criteria," are hereby amended as follows: Comprehensive Plan 2040 Future Land -Use Large Scale Commercial Location Criteria • Should be located at the intersection of two arterial roadways, or along an arterial corridor, OR • Should be located at the intersection of an arterial roadway and a freeway, or along the frontage of a .freeway, OR • Should be an extension of an established commercial area that does not conflict with adjacent residential uses, regardless of if located at an intersection. • Low to medium density multi -family developments: o Should have access to a freeway, arterial, or collector street; o Should not be located within 300.feet of an established single-family large lot of estate area or single- suburban style subdivision unless it is part of the same development or unless it is part of a planned unit development; and o Should not be located within a half mile of existing multi -family developments, unless it continues the character of'the neighborhood. o When making decisions within the ETJ, large scaled development shall be given priority. • High density multi -family developments: o Should have access to an arterial roadway or freeway; o Should be located within a half mile of'large scale commercial or mixed -use developments, and/or within a half'mile of a fixed transit route; o Should not be greater than 15 acres; o Should not be located within a half'mile of'existing multi -family developments; and o Should not be within 450 feet of an existing single-family large lot of estate home or single-family suburban style home area unless it is part of the same development or unless it is part of a planned unit development. o When making decisions within the ETJ, large scaled development shall be given priority. Industrial Location Criteria • Light Industrial: o Should be located along an arterial roadway or- freeway. o Some uses may need direct rail service and/or water access. o Should not be located within 400 feel of "residential uses. o When making decisions within the ETJ, large scaled development shall be given priority. • Heavy Industrial: o Should he located along an arterial roadway orfreeway. o Some uses may need direct rail service and/or water access. o Should not be located within 1,000 feet ofresidential uses. o Hearr industrial should be located within an identified industrial district area. o When making decisions within the ETJ, large scaled development shall be given priority_ Industrial districts are designated areas within Baytown's ETJ where the City of Baytown offers ongoing abatements in lieu of annexation through an Industrial District Agreement. for recurring periods of seven years. Baytown currently has three industrial district areas and many separate Industrial District Agreements. If necessary, additional industrial district areas may be established within the City of Baytown's ETJ. The latest maps showing industrial district locations are available via the City's online GIS snap platform. It is recognized that there are existing legacy industrial uses that do not meet these criteria and appear on the Future Land Use Map under the assumption that the legacy uses will continue into the, future. ADOPTED 05/26/2022 Section 3: Any person who fails to comply with any provision contained in Sections 1-6 of this ordinance shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine not exceeding TWO THOUSAND AND NO/ 100 DOLLARS ($2,000.00). Each act of violation and each day upon which such violation shall occur shall constitute a separate offense. In addition to the penalty prescribed above, the city may pursue other remedies such as abatement of nuisances, injunctive relief, administrative adjudication and revocation of licenses or permits. Section 4: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all other respects, this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 5: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances shall for any reason be held unconstitutional, void, or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances; and to this end, all provisions of this ordinance are declared to be severable. Section 6: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this 3 ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after passage of this ordinance.
