HomeMy WebLinkAbout2026 07 09 MDD Joint Meeting MINUTES OF THE JOINT REGULAR MEETING OF THE CITY COUNCIL AND THE BAYTOWN MUNICIPAL DEVELOPMENT DISTRICT July 09, 2026 The City Council and Baytown Municipal Development District (MDD) of the City of Baytown met in a Regular Joint Meeting on Thursday, July 09, 2026, at 6:30 P.M. in the Council Chamber of the Baytown City Hall at 2401 Market Street, Baytown, Texas, with the following in attendance: Laura Alvarado Mayor Pro Tem/Vice President Sarah Graham Council Member/ Director Kenrick Griffith Council Member/ Director James Franco Council Member/Director Jacob Powell Council Member/Director Mike Lester Council Member/Director Charles Johnson Mayor/President Jason Reynolds City Manager/General Manager Scott Lemond City Attorney/General Counsel Angela Jackson City Clerk/Assistant Secretary Steve Dorris Acting Sergeant at Arms Mayor / President Charles Johnson convened the July 09, 2026 City Council and Municipal Development District (MDD) Joint Meeting with a quorum present at 6:38 P.M. All members were present. The Pledge of Allegiance and Texas Pledge were led by the Baytown Little League representatives Drake Schimming and Anthony Fuente. Invocation was led by Council Member/ Director Mike Lester. 1. CITIZEN COMMENTS Mayor/President Charles Johnson announced no citizens signed up to speak and took a point of privilege to recognize individuals in attendance who currently serve or have served the City of Baytown community. Mayor / President Charles Johnson pulled Item 4.a., recognizing the Baytown Little League for their accomplishments. 2. MUNICIPAL DEVELOPMENT DISTRICT ITEMS a. Conduct a public hearing concerning the Baytown Municipal Development District's Fiscal Year 2026-2027 Proposed Budget. City Council Regular Joint MDD Meeting Minutes July 09,2026 Page 2 of 14 At 6:50 P.M., President Charles Johnson opened the public hearing regarding the Baytown Municipal Development District 2026-2027 proposed budget. Director of Finance Teresa McKenzie summarized the subject matter of the hearing(Exhibit A). President Charles Johnson announced no citizens signed up to speak on the item. At 6:51 P.M., President Charles Johnson closed the public hearing regarding the Baytown Municipal Development District 2026-2027 proposed budget. b. Consider approving the minutes of the City Council Work Session and City Council Municipal Development District meeting held on June 11,2026. President Charles Johnson announced an amendment to Item 2.b., removing the City Council Work Session from the MDD minutes for approval to reflect with only the City Council and MDD Minutes. A motion was made by Director Sarah Graham and seconded by Vice President Laura Alvarado to approve the minutes of June 11, 2026. The vote was as follows: Ayes: President Charles Johnson, Vice President Laura Alvarado, Director Sarah Graham, Director Kenrick Griffith, Director James Franco, Director Jacob Powell and Director Mike Lester Nays: None Approved 3. CITY COUNCIL ITEMS—MINUTES a. Consider approving the minutes of the City Council Work Sessions and City Council Municipal Development District meetings held on June 11,2026. A motion was made by Council Member Sarah Graham and seconded by Council Member Kenrick Griffith to approve the minutes of June 11, 2026. The vote was as follows: Ayes: Mayor Charles Johnson, Mayor Pro Tern Laura Alvarado, Council Member Sarah Graham, Council Member Kenrick Griffith, Council Member James Franco, Council Member Jacob Powell, and Council Member Mike Lester Nays: None Approved 4. RECOGNITIONS AND CITIZEN COMMUNICATIONS • City Council Regular Joint MDD Meeting Minutes July 09,2026 Page 3 of 14 a. Recognize the Baytown Little League for its outstanding season and achievements. Mayor Charles Johnson addressed this item before Item 2.b. Council Member James Franco, expressed appreciation to all those that make it possible for the young men to play baseball and recognized the teams hard work and commitment to the game. Mr. Franco introduced Baytown Little League President Shawn Schimming. Mr. Schimming shared the purpose of the Baytown Little League and the team's year of accomplishments. 5. PUBLIC HEARINGS a. Conduct a public hearing regarding the proposed voluntary annexation of approximately 0.998 acres at 8220 North State Highway 146 (SH 146). At 6:53 P.M., Mayor Charles Johnson opened the public hearing regarding the proposed voluntary annexation of approximately 0.998 acres. Director of Planning and Development Services Martin Scribner summarized the subject matter of the hearing(Exhibit B). Mayor Charles Johnson announced no citizens signed up to speak on the item. At 6:56 P.M., Mayor Charles Johnson closed the public hearing regarding the proposed voluntary annexation of approximately 0.998 acres. 6. PROPOSED LIMITED PURPOSE ANNEXATION OF APPROXIMATELY 356.99 ACRES,LOCATED GENERALLY NORTH OF EAST WALLISVILLE ROAD, EAST OF GARTH ROAD AND WEST OF HADDEN ROAD. a. Conduct the first public hearing regarding the First Amendment to the Strategic Partnership Agreement related to a limited purpose annexation with Harris County Municipal Utility District No. 213-A. At 6:56 P.M., Mayor Charles Johnson opened the public hearing regarding the First Amendment to the Strategic Partnership Agreement with Harris County. Director of Planning and Development Services Martin Scribner summarized the subject matter of the hearing for Items 6.a., and 6.b. Assistant City Attorney Kristin Holmes provided the timeframe and current updates for the agreement related to Items 6.a., and 6.b. Mayor Charles Johnson announced no citizens signed up to speak on the item. Conduct the second public hearing regarding the First Amendment to the Strategic Partnership Agreement related to a limited purpose annexation with Harris County Municipal Utility District No. 213-A. At 6:59 P.M., Mayor Charles Johnson opened the public hearing regarding the First Amendment to the Strategic Partnership Agreement with Harris County. Assistant City Attorney Kristin Holmes reiterated this item was discussed with Item 6.a. Mayor Charles Johnson announced no citizens signed up to speak on the item. At 7:00 P.M., Mayor Charles Johnson closed the public hearing regarding the First Amendment to the Strategic Partnership Agreement with Harris County. Mayor Charles Johnson announced Items 6.c., and 6.d., would be taken together. c. Consider an ordinance authorizing the First Amendment to the Strategic Partnership Agreement with Harris County Municipal Utility District 213-A. Director of Planning and Development Services Martin Scribner provided a description of the location regarding the strategic partnership agreement(Exhibit C). A motion was made by Council Member Sarah Graham and seconded by Council Member Jacob Powell to approve Items 6.c., and 6.d. SPECIAL DISTRICTS BUDGET FOR FISCAL YEAR 2026-2027 a. Receive the Baytown Crime Control and Prevention District Fiscal Year 2026-2027 Adopted Budget. Director of Finance Teresa McKenzie provided the 2026 - 2027 Crime Control and Prevention District adopted budget(Exhibit D). Mayor Charles Johnson acknowledged the budget was received. b. Receive the Baytown Fire Control, Prevention, and Emergency Medical Services District Fiscal Year 2026-2027 Adopted Budget. Director of Finance Teresa McKenzie provided the 2026 - 2027 Fire Control, Prevention, and Emergency Medical Services District adopted budget (Exhibit E). Mayor Charles Johnson acknowledged the budget was received. 8. PROPOSED ORDINANCES City Council Regular Joint MDD Meeting Minutes July 09,2026 Page 6 of 14 a. Consider an ordinance authorizing a Chapter 380 Economic Development Agreement between the City of Baytown, Texas Roadhouse of Baytown, TX LLC, and Strategic Restaurant Enterprises, Inc. Economic Development Manager Brian Moran provided a presentation regarding the Chapter 380 Economic Development Agreement with Texas Roadhouse. Council Members expressed their recommendations regarding the continued development of the area and requested clarification for the facilities. Alex Westcott with Texas Roadhouse Team, provided clarification regarding the expansion of the building and the 380 agreement stipulations. A motion was made by Mayor Pro Tem Laura Alvarado and seconded by Council Member Sarah Graham to approve Ordinance No. 16,515. The vote was as follows: Ayes: Mayor Charles Johnson, Mayor Pro Tern Laura Alvarado, Council Member Sarah Graham, Council Member Kenrick Griffith, and Council Member Jacob Powell Nays: Council Member James Franco, and Council Member Mike Lester Approved ORDINANCE NO. 16,515 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AND THE CITY CLERK TO ATTEST TO A CHAPTER 380 ECONOMIC DEVELOPMENT AGREEMENT WITH TEXAS ROADHOUSE OF BAYTOWN, TX LLC AND STRATEGIC RESTAURANT ENTERPRISES, INC. TO FACILITATE THE CONSTRUCTION AND REHABILITATION OF A NEW RESTAURANT FACILITY LOCATED ON A 2.0000-ACRE TRACT AT 6619 GARTH ROAD AND 6649 GARTH ROAD; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN AS AUTHORIZED IN SAID AGREEMENT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. b. Consider an ordinance regarding proposed text amendments to the Unified Land Development Code (ULDC) to change Section 2.31 Consolidated Use Table; to change Section 2.33 Use Specific Standards; and to change Article 10 Word Usage regarding short- term rentals. City Council Regular Joint MDD Meeting Minutes July 09,2026 Page 7 of 14 Director of Planning and Development Services Martin Scribner presented the text amendments for short-term rentals (Exhibit F). Council Members shared their recommendations regarding amendments to the ordinance. Mr. Scribner provided details that outline the processes for implementing some of the recommendations from Council. City Attorney Scott Lemond provided clarification on outside court proceedings and how the City of Baytown is able to utilize that information. Scott Taylor, 442 S. Burnett Dr., expressed his concern for the safety of the community and city services utilized to maintain the short-term rentals in a recent experience he had with the tenants. A motion was made by Council Member Kenrick Griffith and seconded by Council Member Sarah Graham to extend Mr. Taylor's time by one minute. The vote was as follows: Ayes: Mayor Charles Johnson, Mayor Pro Tem Laura Alvarado, Council Member Sarah Graham, Council Member Kenrick Griffith, Council Member James Franco, Council Member Jacob Powell and Council Member Mike Lester Nays: Approved Steve White, 2439 Bay Hill Dr., shared his opinions if the ordinance is approved and how this will affect the current city environment. Calvin Mundinger, 411 N. Burnett Dr., provided recent court cases referencing the ban on short- term rentals and the negative impact that they will have in the community. Carla Percy, 5002 Ashwood Dr., shared a few personal experiences with short-term rentals within her neighborhood and what it does to the local home values. Nora Smith, 5007 Ashwood Dr., stated the main concern with allowing short-term rentals is the enforcement capacity for overseeing the short-term rentals are abiding by the ordinance. Kenan Schultz, 5008 Ashwood Dr., provided the potential negative impacts or crimes within the residential areas by allowing these short-term rentals. Steve Wavro, 4716 Saint Andrews Dr., shared the uncertainty for the neighbors of the short-term rentals and the reason residents chose to live in Baytown neighborhoods. Jeanne Heves, 1209 Dwinnell St., shared her recommendations to remove the short-rentals and concerns for her own safety and that of local residents. City Council Regular Joint MDD Meeting Minutes July 09,2026 Page 8 of 14 Marie Drewnowski, 4705 Burning Tree Dr., shared her opinions and suggestions for the ordinance permitting short-term rentals within residential areas. Hope McMaster, 4910 Goose Creek Dr., shared personal experiences with a short-term rental in her neighborhood, causing damages and inconveniences to her property. Randee King, 128 N. Burnett Dr., shared statistics of other cities that permitted short-term rentals within residential areas and the required man-power for enforcement of policies. Chet Theiss, 211 Post Oak Dr., shared his opinion regarding the reason these neighborhoods were originated and requested that this ordinance not be approved. Council Members expressed their personal experiences with short-term rentals and how these decisions affect home owners. A motion was made by Council Member Kenrick Griffith and seconded by Council Member Sarah Graham to extend Mr. Theiss's time by one minute. The vote was as follows: Ayes: Mayor Charles Johnson, Mayor Pro Tem Laura Alvarado, Council Member Sarah Graham, Council Member Kenrick Griffith, Council Member James Franco, Council Member Jacob Powell and Council Member Mike Lester Nays: Approved Lisa Hunsinger, 4511 Alamance Dr., shared her recommendation for placement of short-term rentals and the insecurity brought on with allowing them in residential areas. The Mayor and Council Members shared their appreciation for those who came out and expressed their understanding for the resident's concerns. A motion was made by Council Member Jacob Powell and seconded by Mayor Pro Tern Laura Alvarado to approve Ordinance No. 16,516. Council Members provided their recommendations for the short-term rental fees. MANAGER'S REPORT • Fire Department o Firefighter Don'Dreon St. Julien recently completed his Associate's degree in fire science from Houston City College. Congratulations on this accomplishment and keep up the good work! o Firefighters Claudio Rojas and Jason Cochran were recognized by one of the charge nurses at the Houston Methodist Emergency Department for their above-and-beyond efforts in assisting with multiple critical patients while hospital staff was shorthanded. Great work by Firefighter Rojas and Firefighter Cochran, we appreciate all you do. • Parks, Recreation Services o Nature&Tourism team is launching new bird-friendly initiatives as part of the Parks and Trails Open Space Master Plan. These efforts focus on protecting habitats, expanding education, and engaging the community to strengthen conservation across the city. By investing in these initiatives, Baytown is supporting wildlife while strengthening the connection between people, place, and the natural environment that defines our community. o Lastly, I want to give a special thank you to our Parks, Recreation&Tourism Department, as well as all City departments that helped make the Fourth of July celebration a success. I would also like to recognize the following team members: Jason Calder, James Moss, JD Giles, Dallas Bish, Blanca Rubio, Jose Barbosa, Mark Guzman, and David Alamia. Their work is often behind the scenes but absolutely critical to an event like this. With America's 250th anniversary, thousands of residents and visitors enjoyed a celebration featured throughout the Houston region and promoted as one of the area's premier Fourth of July events. It was wonderful to see our community come together to celebrate. Council Member James Franco, expressed appreciation to the City Manager and City Attorney for their commitment to provide as much information to the residents of Baytown. 11. City Council Regular Joint MDD Meeting Minutes July 09,2026 Page 14 of 14 Council Member Mike Lester reported the current projects,programs and events of District 6: District 6 continues to see new business developments, with the following locations in progress. • Planning& Development Services o Cemex Construction Materials— 1200 sq. ft. shop addition(4008 N SH 146) o Goose Creek Consolidated Independent School District(GCCISD)Cedar Bayou Junior High—remodel project(2610 E Elvinta St.) • Parks, Recreation, and Tourism o The Baytown Youth Judo &Jiu-Jitsu classes began this month at the Roseland Clubhouse in District 6. The program was introduced to the community during the City's Fourth of July Festival, where instructors and students demonstrated techniques and answered questions. o Volunteers from the Girl Scouts will help clean up Roseland Park on July 11 to as part of Baytown's ongoing efforts to keep parks clean and welcoming. o ExxonMobil engineering interns partnered with the City to assemble monofilament fishing line collection bins, which will be installed at several parks, including Roseland Park. These bins provide a safe way to dispose of used fishing line and help protect local wildlife and waterways. • Public Works and Engineering o Pipe flushing operations were performed along Pecan Drive to ensure pipes are clear for stormwater flow. o East District Wastewater Treatment Plant — Phase 1 has reached substantial completion. Phase 2 construction remains on schedule and continues to advance through major milestones. o James Street Lift Station notice to proceed for construction will be issued this month, after which mobilization and construction activities will commence.
