HomeMy WebLinkAboutOrdinance No.16512 (Item 8.d.)ORDINANCE NO. 16,512 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING PAYMENT IN AN AMOUNT OF FIVE HUNDRED SIXTY-NINE THOUSAND EIGHT HUNDRED SIXTY-FIVE AND 00/100 DOLLARS ($569,865.00) TO NATIVE CONSTRUCTION FOR THE PURCHASE OF REMOVAL AND DISPOSAL OF DERELICT PILINGS AND RECONSTRUCTION OF NEW PIERS SERVICES FOR THE BAYTOWN NATURE CENTER THROUGH THE PURCHASING COOPERATIVE BUYBOARD PROGRAM, CONTRACT #728-24; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City of Baytown is a member of the cooperative purchasing program established under Sections 271.082 and 271.083 of the Texas Local Government Code; and WHEREAS, the Texas Local Government Purchasing Cooperative's BuyBoard Program is such a program, allowing municipalities to purchase products and/or services in an efficient, cost effective, and competitive procurement method; and WHEREAS, the City of Baytown, in making a purchase under a contract through such cooperative purchasing program, satisfies state law requiring municipalities to seek competitive bids for the purchase of the items and services referenced herein; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes the payment in the amount of FIVE HUNDRED SIXTY-NINE THOUSAND EIGHT HUNDRED SIXTY-FIVE AND 00/100 DOLLARS ($569,865.00) to Native Construction for the purchase of removal and disposal of derelict pilings and reconstruction of new piers services for the Baytown Nature Center through The Purchasing Cooperative BuyBoard Program, Contract #728-24. Section 2: That the City Council of the City of Baytown, Texas, hereby authorizes and directs the City Manager to execute and the City Clerk to attest to the Supplemental Agreement for the Removal and Disposal of Derelict Pilings and Reconstruction of New Piers Services. A copy of said agreement is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes. Section 3: That the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO/100 DOLLARS ($50,000.00) or less. provided that the original contract price may not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
