HomeMy WebLinkAboutOrdinance No. 16,488 (Item 6.m.)ORDINANCE NO. 16,488 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, APPROVING THE APPLICATION FOR PIPELINE PERMIT OF TARGA GULF COAST NGL PIPELINE LLC, TO INSTALL A THIRTY -INCH NATURAL GAS LIQUIDS PIPELINE IN THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF BAYTOWN, TEXAS; ESTABLISHING THE AMOUNT OF THE BOND; AUTHORIZING AND DIRECTING THE DIRECTOR OF ENGINEERING TO ISSUE THE PERMIT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Targa Gulf Coast NGL Pipeline LLC ("Targa"), has submitted a pipeline application to install a thirty -inch natural gas liquids pipeline in the extraterritorial jurisdiction of the City of Baytown ("Pipeline"); and WHEREAS, the Director of Engineering/Director of Public Works, based upon the assessment of the Director of Planning and Community Development, the Fire Chief, and the Emergency Management and Preparedness Coordinator as to compliance with Article V of Chapter 34 of the Code of Ordinances of the City of Baytown, Texas, and based upon her examination of the applications and plans for the Pipeline, has issued a report to the City Council recommending granting the permit for the Pipeline; and WHEREAS, the City Council has received such report and has determined that, based upon the representations of Targa, the application meets all applicable provisions of Article V of Chapter 34 of the Code of Ordinances of the City of Baytown, Texas, as well as all federal and state regulations; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That, subject to receipt of the bond specified in Section 4 hereof, the City Council of the City of Baytown hereby approves the application for pipeline permit, which is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes, to Targa, for the Pipeline described therein, and authorizes and directs the Director of Engineering to execute such permit. Section 2: That, Targa shall construct the Pipeline as referenced in the Site Map attached hereto as Exhibit `B" and incorporated herein for all intents and purposes. Section 3: That, subject to receipt of the bond specified in Section 4 hereof, the City Council of the City of Baytown hereby authorizes and directs the City Manager and the City Clerk to execute and attest to an indemnity agreement with Targa NGL Pipeline Company, LLC, corresponding to the Pipeline. Section 4: That the City Council of the City of Baytown hereby establishes ONE -MILLION AND NO/100 DOLLARS ($1,000,000.00) as the amount of the bond or other form of security satisfactory to the City, which shall be tendered prior to any construction, repair, adjustment, relocation or replacement of the pipeline pursuant to Section 34-233 of the Code of Ordinances, Baytown, Texas. Section 5: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. Dear Mr. Macias: Targa Gulf Coast NGL Pipeline LLC whose address is 811 Louisiana Suite 2100, Houston, Texas 77002, is hereby requesting a pipeline permit. The pipeline will be used to transport NGL's (MSDS sheet attached) from Targa's Facility in Mont Belvieu to Targa's Facility in Galena Park. The route will go through the E.T.J. of the City of Baytown as shown on the map attached. The route will cross Hadden Road, N. Main Street, Barbers Hill Road/FM1942(TXDOT), Garth Road, Glenwood Road, Fairview Drive, Danek Road, Sralla Road, and Eagleton Road (see the attached- detail plans & profiles). There will be a mainline valve located at Barbers Hill Road within the E.T.J. of the City of Baytown, other valves outside the City's jurisdiction will be located near Winfree Road and Crosby Lynchburg Road shown on the cover sheet. The pipe will be 30.000" outside diameter with a 0.593" wall thickness and will be API 5L X-65 HSAW pipe, PSI-2 with 14-16 MILS a fusion bond epoxy coating & 30 MILS ARO Coating under the roads. The pipeline will operate at a maximum operating pressure of 1440 PSIG, will be tested to a minimum 1800 PSIG, and have minimum yield strength of 65,000 PSI. The pipeline will be regulated by the Texas Railroad Commission as an Intrastate Pipeline.
