AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE PURCHASE OF WIRELESS VOICE AND DATA SERVICES AND
ASSOCIATED EQUIPMENT FROM T-MOBILE USA INC. THROUGH A COOPERATIVE
PURCHASING AGREEMENT WITH NASPO VALUEPOINT, CONTRACT #MA 176, AND
AUTHORIZING PAYMENT IN AN AMOUNT NOT TO EXCEED ONE HUNDRED
TWENTY-SEVEN THOUSAND AND 08/100 DOLLARS ($127,000.08); MAKING OTHER
PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.

WHEREAS, the City of Baytown is a participating member of the NASPO ValuePoint Cooperative
Purchasing Program, which authorizes leading states to take bids for certain items and services and for the City
of Baytown to make purchases based upon bids received;
WHEREAS,the lead state of Utah has taken bids for a Wireless,Data, and Voice and Accessories Master
Agreement, No. MA176, for use by state agencies and other entities via the NASPO ValuePoint Cooperative
Purchasing Program; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby authorizes the purchase of wireless
voice and data services and associated equipment from T-Mobile USA, Inc through a cooperative purchasing
agreement with NASPO ValuePoint,contract#MA 176,and authorizing payment in an amount not to exceed ONE
HUNDRED TWENTY-SEVEN THOUSAND AND 08/100 DOLLARS ($127,000.08)
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated §252.048,
the City Manager is hereby granted general authority to approve any change order involving a decrease or an
increase in costs of FIFTY THOUSAND AND NO/100 DOLLARS($50,000.00)or less,provided that the original
contract price may not be increased by more than twenty-five percent(25%) or decreased by more than twenty-
five percent(25%) without the consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
