ORDINANCE NO. 16,473 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, APPROVING TWO PROPERTIES AS RECIPIENTS OF THE FY22 FLOOD MITIGATION ASSISTANCE (FMA) PROGRAM, 1400 AND 1422 KILGORE ROAD; AUTHORIZING REIMBURSEMENT TO RECIPIENTS; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, on or about July 14, 2024, the City of Baytown (CITY), entered into a CONTRACT with the Texas Water Development Board (TWDB), the RECIPIENT, serving as administrator of the Federal Emergency Management Agency(FEMA)Flood Mitigation Assistance (FMA) Program to reduce or eliminate the risk of repetitive flood damage to buildings insured by the National Flood Insurance Program(NFIP). WHEREAS, CITY applied through TWDB for a FEMA project grant under the FMA Program to mitigate specific flood problems. WHEREAS, the United States of America, through the Director of FEMA, has agreed to provide funds to CITY, through TWBD, for the federal share of THE TOTAL PROJECT COST. WHEREAS, CITY will receive grant funds and will be responsible for the execution of the Contract. WHEREAS, two properties have been identified as qualifying for the FY22 FMA grant, 1400 and 1422 Kilgore Road, and each has entered into a contract with a pre-approved elevation construction contractor to do the elevation: Planet Three Consulting and Arkitektura. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown,Texas accepts all of the recitals in the foregoing paragraphs as true and incorporates them by reference as if fully set forth herein. Section 2: That the City Council of the City of Baytown,Texas approves two Elevation Project Agreements as FY22 FMA grant recipients concerning their homes located at 1400 and 1422 Kilgore Road The costs are outlined in the attached Elevation Contracts and the two pre-approved elevation construction contractors: Planet Three Consulting and Arkitektura. The City Council of the City of Baytown authorizes reimbursement according to the July 14, 2024 contract identified above and as outlined below: Homeowner Property Address Pre-Approved Amount Elevation Construction Contractor Thomas Logan 1400 Kilgore Rd Arkitektura $335,916.98 Development, Inc. William Fette III and 1422 Kilgore Rd Planet Three S332,980.60 Nance Fette Consulting Corp Section 3: That the City Council of the City of Baytown authorizes the City Manager to perform any duties necessary reimburse the funds to the proper recipients according to the July 14, 2024 contract. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
