HomeMy WebLinkAbout2026 04 09 City Council Regular MeetingMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN April 09, 2026 The City Council of the City of Baytown, Texas, met in a Regular Meeting on Thursday, April 09, 2026 at 6:30 P.M. in the Council Chamber of the Baytown City Hall at 2401 Market Street, Baytown, Texas, with the following in attendance: Laura Alvarado Mayor Pro Tem Kenrick Griffith Council Member James Franco Council Member Mike Lester Council Member Charles Johnson Mayor Jason Reynolds City Manager Scott Lemond City Attorney Angela Jackson City Clerk John Stringer Sergeant at Arms Mayor Charles Johnson convened the April 09, 2026 Regular City Council Meeting with a quorum present at 6:42 P.M. All members were present with the exception of Council Member Sarah Graham and Council Member Jacob Powell who were absent. The Pledge of Allegiance, Texas Pledge, and Invocation were led by Council Member Mike Lester. 1. CITIZEN COMMENTS Mayor Charles Johnson announced citizens signed up to speak. Desiree Klaus, 9026 Blue Star Ln., shared her concerns of an overgrown retention pond off Garth Rd. 2. MINUTES a. Consider approving the minutes of the Municipal Development District and City Council Regular Joint Meeting held on March 12, 2026. A motion was made by Council Member Kenrick Griffith and seconded by Mayor Pro Tem Laura Alvarado to approve the minutes for March 12, 2026, as submitted. PRESENTATIONS a. Present the Juneteenth and 4th of July Celebration schedules and entertainment lineup for 2026. Director of Parks Recreation and Tourism Clifford Hatch presented the lineup and events to be held at the Juneteenth and Fourth of July celebrations. (Exhibit A) 4. PUBLIC HEARINGS a. Conduct a public hearing to amend the official zoning map to rezone approximately 20.36 acres located at 1301 East Interstate Highway (IH)10, from Freeway Commercial (FC) to a Planned Unit Development (PUD) Zoning District. Mayor Charles Johnson informed the City Council the applicant has requested to push this item. 5. PROPOSED ORDINANCES a. Consider an ordinance to amend the official zoning map to rezone approximately 20.36 acres located at 1301 East Interstate Highway (IH) 10, from Freeway Commercial (FC) to a Planned Unit Development (PUD) Zoning District. Mayor Charles Johnson informed the City Council the applicant has requested to push this item. b. Consider an ordinance adopting the proposed text amendment to Chapter 111, Uni- fied Land Development Code (ULDC) of the Baytown Code of Ordinances to revise Divisions 2.32, 2.33, 2.35, 2.36, and 10.2 of the ULDC, regarding shipping containers, and the definition of container or shipping container as it applies to the 2025 code. Assistant Director of Planning and Development Services Calvin Abram provided an overview of the request to amend Chapter 111, with the approval from Planning and Zoning Commission. City Attorney Scott Lemond provided a hand out to the City Council Members regarding requested amendments. (Exhibit B) Council Members shared their recommendations regarding an exception to address residential use. City Manager Jason Reynolds provided suggestions for amendments accommodating the City Council Members request. City Council Regular Meeting Minutes April 09, 2026 Page 3 of 12 Mr. Abram clarified that the amendment was to permit an eight foot by forty -foot shipping container will be allowed and will not require a permit in residential areas, abiding by set guidelines. A motion was made by Council Member Mike Lester and seconded by Mayor Pro Tem Laura Alvarado to approve Ordinance No. 16,440, with requested amendment. PROPOSED RESOLUTIONS a. Consider a resolution of the City Council of the City of Baytown extending the Civil Service Line of Duty Injury Leave of Absence of a Firefighter. Mayor Charles Johnson stated Item 6.a., will be taken out of order and discussed in executive session. City Attorney Scott Lemond provided legal guidance to amend and extend the resolutions. A motion was made by Mayor Charles Johnson and seconded by Council Member Kenrick Griffith to approve Resolution No. 3088, and No. 3089, amending Resolution No. 3064 and extending leave by forty-five (45) days. Assistant Director of Capital Improvements with Public Works and Engineering Rafael Errisuriz provided a summary regarding the amended and restated agreement. Council Members shared previous incidents bringing concern for the current drainage and im- portance to address it for the residents. City Manager Jason Reynolds clarified the amendment, and funding needed to reimburse the funds to Harris County. FOR ENGINEER DESIGN SER- VICES FOR THE RENOVATION/RELOCATION OF THE MOSQUITO CONTROL BUILDING PROJECT; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN AN AMOUNT NOT TO EXCEED EIGHTY-ONE THOUSAND NINE HUNDRED EIGHTY-TWO AND NO/100 DOLLARS ($81,982.00); MAKING OTHER PROVISIONS RE- LATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. g. Consider an ordinance authorizing an Interlocal Agreement with Harris County for the Neighborhood Street Reconstruction of Lantern Park, Dolphin Harbor, Canvasback Cay, and South Circle Drive Project. Assistant Director of Capital Improvements with Public Works and Engineering Rafael Errisuriz provided a summary regarding the street reconstruction and recommended approval. Council Members expressed appreciation for ensuring this project continued and clarification was provided regarding funding to subsidize. Mayor Charles Johnson thanked Precinct 2 Commissioner Adrian Garcia for providing this fund- ing to the City of Baytown. A motion was made by Council Member Kenrick Griffith and seconded by Council Member Mike Lester to approve Ordinance No. 16,488., with amendment. ORDINANCE NO. 16,446 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAY - TOWN, TEXAS, AUTHORIZING THE PAYMENT OF ONE -HUN- DRED, SEVENTEEN -THOUSAND AND NO/100 DOLLARS ($117,000.00) TO CUBIC ITS, INC., FOR THE PURCHASE OF TRAF- FIC SIGNAL CABINETS THROUGH THE TEXAS LOCAL GOVERN- MENT PURCHASING COOPERATIVE (BUY BOARD); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Mayor Charles Johnson took a point of privilege to show support and appreciation to the residents attending today's meeting. 8. MANAGER'S REPORT City Manager Jason Reynolds presented the Manager's Report: o Parks, Recreation, and Tourism would like to recognize two team mem- bers for their commitment to professional development. Kyle Frye and Abel Carmona were recently recertified as Certified Park and Recreation Professionals (CPRP) through the National Recreation and Park Associa- tion. This nationally recognized certification demonstrates continued ex- pertise across key areas such as operations, programming, finance, and leadership, and reflects a commitment to staying current in the profession. Congratulations to Kyle and Abel! o Household Hazardous Waste Collection Day is April 18th from 9 A.M. — 2 P.M. at 1200 Lee Drive. This is your chance to dispose of old paint, gas- oline, car batteries, cleaners, fertilizers, and more without leaving your ve- hicle. o A special shout out from a rabbit who was left abandoned in a hotel room. Our Animal Control Officers (ACO) responded to the call and the Out- comes Team were able to transfer him to Houston Rabbit Resource. In ad- dition to the rabbit, the Outcomes Team (a duo of Keri Meyer and Amanda Gonzales) also transferred 77 animals in the last month to local rescue groups. Please come out and meet the design team, learn more about the project, and share your ideas o Baytown Fire Department Memorial Ceremony will be held on Monday, April 13th at 4 P.M. at the Firefighter Memorial in Bicentennial Park. Mr. Reynolds expressed his appreciation to the Public Affairs Department for their efforts with the Washington D.C. event, and sharing the importance of attending these meetings to advocate for the City of Baytown. Mayor Charles Johnson shared their recent trip to Washington D.C. to address matters and shared he met with the Environmental Protection Agency (EPA) regarding the San Jacinto Waste Pits. Mayor Johnson provided the current events held at the Library. 10. COUNCIL MEMBER DISTRICT REPORT a. Receive a report from Council Member Mike Lester regarding projects, programs and events in District No. 6. Council Member Mike Lester reported the current projects, programs and events of District 6: • Public Works and Engineering (PWE) o East District Wastewater Treatment Project Phase 1: Construction continues to advance with strong progress on both exterior and interior components. The parking lot and sidewalk for the new operations building have been com- pleted, marking a key milestone for site access and usability. Interior finishes are moving forward, with drywall sanding underway in preparation for paint- ing. o East District Wastewater Treatment Project Phase 2: Work is actively pro- gressing across the Belt Press, Chemical, and Electrical Buildings. Structural advancement continues, highlighted by the completed deck pour for the Belt Press Building, positioning the project for continued vertical construction. • Planning and Development Services (PDS) o 3030 Ferry Rd is under inspection for a new administration building for the City of Baytown east district wastewater treatment plant. This project is half- way complete. • Parks Recreation and Tourism (PRT) o PRT continues to see strong usage at District 6's Tabbs Bay Disc Golf Course. So far in 2026, the course has attracted over 100 out-of-town players from across the country, along with approximately 300 local visitors. The course City Council Regular Meeting Minutes April 09, 2026 Page 12 of 12 remains well received, maintaining a 4.7 out of 5-star rating, and continues to serve as both a valued community amenity and a growing regional draw. o Also, at Tabb's Bay, PRT was notified of wild hog activity and was able to contract with Texas Wild Hogg Control to trap and remove the animals on site. Over the past month, the contractor has removed 6 young hogs, 1 female hog, and 2 male hogs. PRT will continue to monitor the area over the coming weeks and will trap as necessary. 10. EXECUTIVE SESSION Mayor Charles Johnson announced Item 6.a., will be taken during executive session. UNIFIED LAND DEVELOPMENT CODE ARTICLE 10. WORD USAGE Division 10.2 Definitions C Container, or Shipping Container, means a reusable structure, typically made of corrugated weathering steel with a fitted door at one end, that may be modified for permanent or temporary residential use as well as commercial and industrial uses. It is designed to allow multiple units to be craned, fitted, and locked for stacking purposes, transport and storage unit for moving products and raw materials between locations or countries .... Section 11: Any person who fails to comply with any provision contained in Sections 1-6 of this ordinance shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine not exceeding TWO THOUSAND AND NO/100 DOLLARS ($2,000.00). Each act of violation and each day upon which such violation shall occur shall constitute a separate offense. In addition to the penalty prescribed above, the city may pursue other remedies such as abatement of nuisances, injunctive relief, administrative adjudication and revocation of licenses or permits. Section 12: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all other respects, this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 13: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances shall for any reason be held unconstitutional, void, or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances; and to this end, all provisions of this ordinance are declared to be severable. Section 14: This ordinance shall take effect from and after ten (10) days from its passage by the City Council.
