CITY COUNCIL OF THE CITY OF BAYTOWN
April 09, 2026
The City Council of the City of Baytown, Texas, met in a Work Session on Thursday, April 09,
2026, at 5:30 P.M. in the Council Chamber of Baytown City Hall, 2401 Market Street, Baytown,
Texas, with the following in attendance:

Mayor Charles Johnson convened the April 09, 2026 City Council Work Session with a quorum
present at 5:39 P.M. All members were present with the exception of Council Member Sarah
Graham and Council Member Jacob Powell who were absent.
1. CITIZEN COMMENTS
Mayor Charles Johnson announced no citizens signed up to speak.
2. DISCUSSIONS
a. Discuss proposed changes to Chapter 42 - Health and Sanitation.
Interim Director Health Shawn Cochran provided an overview regarding phase one of two
pertaining to Chapter 42 Health and Sanitation, and introduced the Assistant Director Health
Timothy Ryan.
Mr. Ryan provided a presentation for proposed ordinance amendments to the health and sanitation
chapter. (Exhibit A)
Mayor Charles Johnson requested further clarification for the proposed amendments.
Council Members expressed their concerns and recommendations regarding the associated cost
and impact to the City's budget.

City Manager Jason Reynolds clarified with the City Council, that a majority expressed consensus
to raise fees associated with health permit fees.
b. Receive the Envisio Quarterly Report.
Assistant to the City Manager Sabrina Martin provided the quarterly Envisio report covering the
City of Baytown and recommendations for any improvements. (Exhibit B)
City Manager Jason Reynolds expanded on the data used to create the Envisio reports.
3. ADJOURN
With there being no further business to discuss, Mayor Charles Johnson adjourned the April 09,
2026, City Council Work Session at 6:21 P.M.

Purpose: Compliance with new state mandates / General Update
SB1008 affected:
• Maximum Fee Cap
• Restricted municipality from permitting an already state
permitted business.
• Removed Food Manufactures, Daycares and LTC Facilities from COB
inventory

Texas Administrative Code (228.31) — Changed the thresholds requiring
an onsite Certified Food Manager.
SB 541 — Further defined Cottage Foods, Cottage Food Producers &
Vendors. Limits local government ability to regulate overall.

Section 42-133 Adoption of State Rules
a
Purpose: Updates due to recent state mandates
Updates sections found in the Texas Health & Safety Code.
• Removes Sections of the Texas Administrative Code no longer in use.
• Adds Current FDA Food Code (2022) to Texas Food Establishment
Regulations as incorporated regulations. This action is consistent with
many cities across the state.
Section 42-151 Cottage Foods

Purpose: To meet new state requirements.
Updates enacted as a result of SB 541"Cottage Food Law"
• Re -defines Cottage Food production operation and adds food items to
the "allowed" list of foods.
• More extensive definition of Time/Temperature Control for Safety
Foods (replaces PHF Potentially Hazardous Foods).
• Specifies that Cottage Food production operations are exempt from
permits and fees
Section 42-177 Food Manager Certification
Paz
Purpose: To meet current state requirements.
Changes found in updated Texas Administrative Code § 228.31
• Food manager shall be present.
• No longer based on amount of staff.
• Establishments required to maintain copies of Food Handler training
certifications for all employees.
