G. Shipping Containers.- Shipping containers may be used as an accessory structure;
, and primary structure when:the shipping container is consistent with the character of the

adopted by;the City:of,Baytown. Shipping containers shall comply with the maximum
height'requirement;;_as:well..as all setback and distance requirements within the applicable
• .zoning:.district: Shipping,containers may not be stacked on one another in a commercial or
• residential zoning.district: Berms, hills, slabs in excess of one foot above natural grade or • •

a. The location of the structure is on the parcel or lot served by the shipping
container.No encroachment into setbacks or over sidewalks is permitted.
b. Where applicable, on nonresidential parcels shipping container staging
may occur in the front yard.
c. Where applicable, shipping containers shall be screened by fencing with
opaque screening and natural plantings where applicable.
d. The facility shall be used only for a construction site within the City or
an infrastructure project that is wholly or partially in the City.
e. Established by approval; to coincide with the use of the facility for a
specified construction project, holiday, or special event.
f. Duration should coincide with the applicable permit.
g. An approved building permit is required to coincide with the shipping
container.

Division 10.2 Definitions

Container, or Shipping Container means a reusable structure, typically made of -
corrugated weathering steel with a fitted door at one end, that may be modified for
permanent or temporary residential use as well as commercial and industrial uses. It is
designed to allow multiple units to be craned, fitted, and locked for stacking purposes,
transport and storage unit for moving products and raw materials between locations or
countries . . . .
Section 11: Any person who fails to comply with any provision contained in Sections 1-6 of this
ordinance shall be guilty of a misdemeanor and,upon conviction, shall be punished by a fine not exceeding
TWO THOUSAND AND NO/100 DOLLARS ($2,000.00).Each act of violation and each day upon which
such violation shall occur shall constitute a separate offense. In addition to the penalty prescribed above,
the city may pursue other remedies such as abatement of nuisances, injunctive relief, administrative
adjudication and revocation of licenses or permits.
Section 12: All ordinances or parts of ordinances inconsistent with the terms of this ordinance
are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency,
and in all other respects, this ordinance shall be cumulative of other ordinances regulating and governing
the subject matter covered by this ordinance.
Section 13: If any provision, section, exception, subsection, paragraph, sentence, clause or
phrase of this ordinance or the application of same to any person or set of circumstances shall for any reason
be held unconstitutional, void, or invalid, such invalidity shall not affect the validity of the remaining
provisions of this ordinance or their application to other persons or sets of circumstances; and to this end,
all provisions of this ordinance are declared to be severable.

Section 14: This ordinance shall take effect from and after ten(10) days from its passage by the
City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this
ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10)
days after passage of this ordinance.
