AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AWARDING THE CONTRACT FOR THREE HOUSING RECONSTRUCTION PROJECTS
LOCATED AT 311 AVENUE J, 2006 W. GULF STREET, AND 1408 OAK STREET TO
R&R COMMERCIAL & RESIDENTIAL CONSTRUCTION, LLC. UNDER THE CDBG
OWNER -OCCUPIED HOUSING REHABILITATION PROGRAM, AUTHORIZING
PAYMENT NOT TO EXCEED THE SUM OF FOUR HUNDRED FOURTEEN THOUSAND
THREE HUNDRED FORTYAND NO/100 DOLLARS ($414,340.00) AS ITEMIZED IN THE
TABLE BELOW; AUTHORIZING PAYMENT THEREOF; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.

WHEREAS, the City of Baytown did advertise for bids for three housing reconstruction projects
located at 311 Avenue J, 2006 W. Gulf, and 1408 Oak Street to be received on October 21, 2025; and
WHEREAS, notice to all bidders as to the time and place, when and where the contract would
be let was published pursuant to provisions of Section 74 of the Charter of the City of Baytown; and
WHEREAS, all bids were opened and publicly read at City Hall at 10:10 a.m., Tuesday, October
21, 2025, as per published notice to bidders; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1 : That the City Council of the City of Baytown hereby accepts the bid of R&R
Commercial and Residential Construction, LLC., for a sum not to exceed FOUR HUNDRED
FOURTEEN THOUSAND THREE HUNDRED FORTYAND NO/100 DOLLARS ($414,340.00), as
itemized in the table below, for the following projects under the CDBG Owner -Occupied Housing
Rehabilitation Program and authorizes payment thereof upon final completion and acceptance of the
work by the owner and the Citv:

Total: $414,340
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated
*252.048, the City Manager is hereby granted general authority to approve any change order involving
a decrease or an increase in costs of FIFTY THOUSAND AND NO/ 100 DOLLARS ($50,000.00) or
less, subject to the provision that the original contract price may not be increased by more than twenty-
five percent (25%) or decreased by more than twenty-five percent (25%) without the consent of the
contractor to such decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
