AMENDING ORDINANCE NUMBER 16,334 WHICH AMENDED THE CODE OF
ORDINANCES, BAYTOWN, TEXAS, CHAPTER III "UNIFIED LAND
DEVELOPMENT CODE," ARTICLE 2 "ZONING DISTRICTS AND DIMENSIONAL
STANDARDS," DIVISION 2.2 "ZONING DISTRICTS AND DIMENSIONAL
STANDARDS," SECTION 2.21 "RESIDENTIAL DISTRICT DIMENSIONAL
STANDARDS," SUBSECTION 2.21-4 "MIXED RESIDENTIAL (MR);" DIVISION 2.3
"USE STANDARDS," SECTION 2.31 "CONSOLIDATED USE TABLE,"
SUBSECTION 2.31-1 "LAND USE TABLE;" DIVISION 2.33 "USE -SPECIFIC

USAGE," DIVISION 10.2 "DEFINITIONS"; TO CHANGE THE EFFECTIVE DATE
AND PROVIDE FOR PUBLICATION THEREOF.
WHEREAS, on December 11, 2025 the City Council of the City of Baytown, Texas passed
Ordinance 16334 Amending the Code of Ordinances, Baytown, Texas, Chapter III "Unified Land
Development Code," Article 2 "Zoning Districts and Dimensional Standards," Division 2.2 "Zoning
Districts and Dimensional Standards," Section 2.21 "Residential District Dimensional Standards,"
Subsection 2.21-4 "Mixed Residential (MR);" Division 2.3 "Use Standards," Section 2.31 "Consolidated
Use Table," Subsection 2.31-1 "Land Use Table;" Division 2.33 "Use -Specific Standards," Subsection
2.33-6 "Industrial Uses;" Article 3 "Development Standards," Division 3.2 "Building and Site Design,"
Section 3.22 "Single -Unit Dwelling and Duplex Development;" Division 3.4 "Tree Preservation,
Landscaping, and Buffering," Section 3.42 "Development Landscaping;" Article 7 "Development Review
Procedures," Division 7.2 "Common Review Procedures," Section 7.210 Development Review Summary;"
Article 10 "Word Usage," Division 10.2 "Definitions", and provided for the effective date and publication
thereof, and
WHEREAS, the Charter of the City of Baytown, Texas requires that notice be given of the passage
of every ordinance imposing a penalty, fine, or forfeiture for a violation of the provisions thereof, by causing
the caption or title, including the penalty, of any such ordinance to be published in the official newspaper
in the City of Baytown at least twice within ten days after the passage of such ordinance;
WHEREAS, the City Council of the City of Baytown, Texas now desires to amend Section 11 of
Ordinance 16334 to change the effective date of the ordinance to ensure compliance with the Charter of the
City of Baytown; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the facts and recitations contained in the preamble of this ordinance are hereby
found and declared by the City Council of the City of Baytown, Texas, to be true and correct.
Section 2: That Section 11 of Ordinance 16334 is hereby amended to read as follows:
"Section 11: That this ordinance shall take effect from and after ten (10) days after
February 12, 2026. The City Clerk is hereby directed to give notice hereof by
causing the caption of this ordinance to be published in the official newspaper of the City
of Baytown at least twice within ten (10) days after February 12, 2026."
Section 3: The remaining provisions of Ordinance 16334 that are not amended herein
shall remain in full force and effect.
Section 4: This ordinance shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
