A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AMENDING RESOLUTION 3061 TO SET A NEW PUBLIC
HEARING DATE REGARDING THE ADVISABILITY OF THE PROPOSED
IMPROVEMENTS IN CONNECTION WITH THE ESTABLISHMENT OF BAY
CREEK PUBLIC IMPROVEMENT DISTRICT NUMBER 2; AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, on January 8, 2026, the City Council (the "City Council") of the City of
Baytown, Texas (the "City") passed Resolution 3061, accepting a petition for the establishment of
the Bay Creek Public Improvement District No. 2 and setting a public hearing date of February
12, 2026 regarding the advisability of the proposed improvements; and
WHEREAS, the Public Improvement District Assessment Act requires that notice of the
public hearing be published in a newspaper of general circulation in the City and mailed to each
property owner within the proposed District, as reflected on the tax rolls, fifteen (15) days prior to
the public hearing; and
WHEREAS, the City Council of the City of Baytown, Texas now desires to amend Section
3 of Resolution 3061 to set a new public hearing date of March 12, 2026 to allow for compliance
with the notice requirements of the Public Improvement District Assessment Act and; NOW
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the findings set forth in the recitals of this resolution are found to be
true and correct.
Section 2: That Section 3 of Resolution 3061, passed by the City Council on January
8, 2026 is hereby amended to read as follows:
"Section 3: On the 121h day of March, 2026, at the regular meeting of the City
Council, which commences at 6:30 p.m., in the City Hall Council Chambers of the City of
Baytown, 2401 Market Street, Baytown, Texas, the City Council will hold a public hearing
giving all interested parties the right to appear and be heard on the advisability of the
improvements, the nature of the improvements contemplated, the estimated costs of the
improvements, the boundaries of the District, the method of assessment, and the
apportionment, if any, of the costs between the District and the City."
Section 3: The City Council hereby authorizes and directs the City Clerk in accordance
with the Act, to: (a) publish notice of the March 12, 2026 public hearing in a newspaper of general
circulation in the City; and (b) mail notice of the public hearing to the owners of property located
in the proposed District as reflected on the tax rolls.
Section 4: The remaining provisions of Resolution 3061 that are not amended herein
shall remain in full force and effect.
Section 5: This resolution shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
