UNIFIED LAND DEVELOPMENT CODE ARTICLE 10. WORD USAGE DIVISION 10.2. DEFINITIONS Container, or shipping container, means a reusable transport and storage unit for moving products and raw materials between locations or countries,typically made of corrugated weathering steel with a fitted door at one end that is designed to allow multiple units to be craned, fitted and locked for stacking purposes. Dwelling, Townhouse means a structure that is one or a series of dwelling units designed for single- unit occupancy, between six and eight dwelling units per structure, which dwelling units are structurally connected or immediately adjacent to each other without side yards between individual dwelling units. n Mobile home means a structure that was constructed before June 15, 1976, transportable in one or more sections, which, in the traveling mode, is eight body feet or more in width or 40 body feet or more in length,or when erected on-site is 320 or more square feet,and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities,and includes the plumbing, heating,air-conditioning and electrical systems. Section 8: Any person who fails to comply with any provision contained in Sections 1-16 of this ordinance shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine not exceeding TWO THOUSAND AND NO. 100 DOLLARS ($2,000.00). Each act of violation and each day upon which such violation shall occur shall constitute a separate offense. In addition to the penalty prescribed above, the city may pursue other remedies such as abatement of nuisances, injunctive relief, administrative adjudication and revocation of licenses or permits. Section 9: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and in all other respects, this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 10: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances shall for any reason be held unconstitutional, void, or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances; and to this end, all provisions of this ordinance are declared to be severable. Section 11: This ordinance shall take effect on December 21, 2025. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within the ten(10) days preceding December 21, 2025.
