A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER
AUTHORITY AUTHORIZING PAYMENT IN THE AMOUNT OF ONE HUNDRED
TWENTY-FIVE THOUSAND EIGHT HUNDRED FIFTY-FIVE AND 00:100 DOLLARS
($125,855.00) TO BROWN AND ROOT INDUSTRIAL SERVICES, LLC FOR THE
PURCHASE OF CONSTRUCTION SERVICES FOR THE RENOVATION OF BAYTOWN
AREA WATER AUTHORITY ADMINISTRATION BUILDING PROJECT THROUGH THE
TEXAS LOCAL GOVERNMENT PURCHASING COOPERATIVE (BUYBOARD),
CONTRACT #728-24; MAKING OTHER PROVISIONS RELATED THERETO; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, the Baytown Area Water Authority is a member of the cooperative purchasing program
established under Sections 271.082 and 271.083 of the Texas Local Government Code; and
WHEREAS, the Texas Local Government Purchasing Cooperative's Buy Board Program is such a
program, allowing the purchase of products and/or services in an efficient, cost effective, and competitive
procurement method; and
WHEREAS, the Baytown Area Water Authority, in making a purchase under a state contract through
such cooperative purchasing program, satisfies state law requiring competitive bids for the purchase of the item
or service; NOW THEREFORE;
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER
AUTHORITY:
Section 1: That subject to the approval of the City Council of the City of Baytown, Texas, the Board
of Directors of the Baytown Area Water Authority hereby authorizes the payment in the amount of ONE
HUNDRED TWENTY-FIVE THOUSAND EIGHT HUNDRED FIFTY-FIVE AND 00/100 DOLLARS
($125,855.00) to Brown and Root Industrial Services, LLC for the renovation of the Baytown Area Water
Authority Administration Building project through the Texas Local Government Purchasing Cooperative (Buy
Board), contract #728-24.
Section 2: That the General Manager is hereby granted general authority to approve any change
order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO 100 DOLLARS ($50,000.00)
or less, provided that the original contract price may not be increased by more than twenty-five percent (25%) or
decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease.
Section 3: This resolution shall take effect immediately from and after its passage by the Board of
Directors of the Baytown Area Water Authority.
