Ordinance No. 16,370 (Item 5.i.)ORDINANCE NO. 16,370 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING PAYMENT NOT TO EXCEED TWO HUNDRED NINETY-FIVE THOUSAND AND NO/100 DOLLARS ($295,000.00) TO O'REILLY AUTO ENTERPRISES, LLC, FOR AUTO PARTS AND SUPPLIES THROUGH THE INTERLOCAL PURCHASING SYSTEM (TIPS), CONTRACT NO. 230604; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************************************* WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement or membership for cooperative purchasing with the Interlocal Purchasing System (TIPS); and WHEREAS, pursuant to such agreement, the City may make purchases based upon the bids received and the negotiated contract entered into by the Interlocal Purchasing System (TIPS); and WHEREAS, the Interlocal Purchasing System (TIPS) has taken bids and entered into a contract for auto parts and supplies; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes payment to O'Reilly Auto Enterprises, LLC in an amount not to exceed TWO HUNDRED NINETY-FIVE THOUSAND AND 00/100 DOLLARS ($295,000.00) for auto parts and supplies through a cooperative purchasing agreement with the Interlocal Purchasing System (TIPS). Section 2: That pursuant to the provisions of Texas Local Government Code Annotated Section 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO/100 DOLLARS ($50,000.00) or less, provided that the original contract price may not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent (25%) without the consent of the contractor to such Decrease. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
