AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING PAYMENT NOT TO EXCEED TWO HUNDRED NINETY-FIVE
THOUSAND AND NO/100 DOLLARS ($295,000.00) TO O'REILLY AUTO
ENTERPRISES, LLC, FOR AUTO PARTS AND SUPPLIES THROUGH THE
INTERLOCAL PURCHASING SYSTEM (TIPS), CONTRACT NO. 230604; MAKING
OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.

WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement or
membership for cooperative purchasing with the Interlocal Purchasing System (TIPS); and
WHEREAS, pursuant to such agreement, the City may make purchases based upon the bids
received and the negotiated contract entered into by the Interlocal Purchasing System (TIPS); and
WHEREAS, the Interlocal Purchasing System (TIPS) has taken bids and entered into a contract for
auto parts and supplies; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby authorizes payment to O'Reilly
Auto Enterprises, LLC in an amount not to exceed TWO HUNDRED NINETY-FIVE THOUSAND AND
00/100 DOLLARS ($295,000.00) for auto parts and supplies through a cooperative purchasing agreement
with the Interlocal Purchasing System (TIPS).
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated Section
252.048, the City Manager is hereby granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTY THOUSAND AND NO/100 DOLLARS ($50,000.00) or less,
provided that the original contract price may not be increased by more than twenty-five percent (25%) or
decreased by more than twenty-five percent (25%) without the consent of the contractor to such Decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
