Ordinance No. 16,338 (Item 8.b.)ORDINANCE NO. 16,338 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PAYMENT IN AN AMOUNT NOT TO EXCEED ONE -HUNDRED, NINETY-EIGHT THOUSAND AND NO 100 DOLLARS ($198,000.00) TO EAN HOLDINGS, LLC D!B;A ENTERPRISE RENT -A -CAR, THROUGH AN INTERLOCAL COOPERATIVE PURCHASING AGREEMENT WITH HARRIS COUNTY AUTHORIZED BY ORDINANCE 13,702, FOR THE RENTAL OF FIFTEEN (15) VEHICLES; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City of Baytown and Harris County entered in to a cooperative purchasing agreement authorized by Ordinance 13,702; and WHEREAS, the City of Baytown, desires to rent fifteen (15) vehicles under the same contract pricing as Houston County Contract Job 22.:0272, which was competitively bid and awarded in October of 2022; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes payment not to exceed the amount of ONE -HUNDRED, NINETY-EIGHT THOUSAND AND NO. 100 DOLLARS ($198,000.00) to EAN Holdings, LLC. d/b/a Enterprise Rent-A-Car ("EAN") for fifteen (15) vehicles, through a cooperative purchasing interlocal agreement between Harris County and the City of Baytown and based on an award between Harris County and EAN under Harris County Contract Job 22'0272. Section 2: That pursuant to the provisions of Texas Local Government Code Annotated §252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO 100 DOLLARS ($50,000.00) or less, provided that the original contract price may not be increased by more than twenty-five percent (25%) or decreased by more than twenty- five percent (25%) without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
