Resolution No. 3051 (Item 8.k.)RESOLUTION NO. 3051 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS REAFFIRMING ITS SUPPORT OF THE BAYTOWN TRICITY BEACH ROAD HIGHWAY SAFETY IMPROVEMENT PROGRAM PROJECT; AUTHORIZING THE CITY MANGER, TO THE EXTENT AUTHORIZED BY LAW, TO ENTER INTO, AND THE CITY CLERK TO ATTEST TO, AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR THE PROJECT; MAKING OTHER FINDINGS AND PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ****************************************************************************** WHEREAS, the Texas Transportation Commission authorized the City of Baytown, Texas (the "City") to receive Highway Safety Improvement Program ("HSIP") funds for the Baytown TriCity Beach Road HSIP project (the "Project"); and WHEREAS, prior to releasing the Advance Funding Agreement ("AFA") for the Project to the City, the Texas Department of Transportation ("TxDot") requires that the City reaffirm its support of the Project; and WHEREAS, the HSIP funds require a local match comprised of local funds or Transportation Development Credits; and WHEREAS, the City of Baytown is responsible for all non -reimbursable costs and 100% of overruns, if any; and WHEREAS, the City desires to reaffirm its support of the Project, approve and authorize the execution of an AFA with TxDOT for the Project at such time as TxDot releases the AFA. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1. The findings set out in the preamble are in all things approved and incorporated herein as if fully set forth. Section 2. The City reaffirms its support of the Project. Section 3. To the extent authorized by law under Chapter 252 of the Texas Local Government Code, and/or Chapters 771 and 791 of the Texas Government Code, the City Manager is authorized to enter into, and the City Clerk to attest to, an AFA with TxDOT for the Project. Section 4. This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown, Texas.
