MINUTES OF THE JOINT MEETING OF THE CITY COUNCIL AND THE BAYTOWN MUNICIPAL DEVELOPMENT DISTRICT September 25, 2025 The City Council and Baytown Municipal Development District (MDD) of the City of Baytown met in a Meeting on Thursday, September 25, 2025, at 6:30 P.M. in the Council Chamber of the Baytown City Hall at 2401 Market Street, Baytown,Texas, with the following in attendance: Jacob Powell Mayor Pro Tern/Director Laura Alvarado Council Member/Vice President Sarah Graham Council Member/Director Kenrick Griffith Council Member/Director James Franco Council Member/Director Mike Lester Council Member/Director Charles Johnson Mayor/President Jason Reynolds City Manager/General Manager Scott Lemond City Attorney/General Counsel Gabriella Gonzales Assistant City Clerk/Assistant Secretary John Stringer Sergeant at Arms Mayor / President Charles Johnson convened the September 25, 2025 City Council and Municipal Development District (MDD) Joint Meeting with a quorum present at 6:36 P.M. All members were present. The Pledge of Allegiance, Texas Pledge, and Invocation were led by Council Member / Vice President Laura Alvarado. 1. CITIZEN COMMENTS Mayor/President Charles Johnson announced citizens signed up to speak. June Stansky, 4601 Driftwood Drive, shared her appreciation for Mayor Charles Johnson and Matt Hollis for stating the bus services should be funded. Ms. Stansky expressed concern for the unfinished West Texas Avenue construction project. Troy Whiteneck, 9946 Bayou Woods Drive, expressed his concern for transparency regarding the bus servicers funding being cut and thanked Mayor Charles Johnson for his efforts to restore the bus service funding. Jeff Walters, 2303 James Bowie Drive, expressed his recommendations and opinions regarding funding of bus services. He stated that the services is used by residents with transportation limitations. MUNICIPAL DEVELOPMENT DISTRICT ITEMS President Charles Johnson announced the City Council will take an executive session. Recess into and conduct an executive session pursuant to Section 551.071 of the Texas Government Code to seek the advice of the City's Attorney on legal matters including, but not limited to, pending or contemplated litigation. Recess into and conduct an executive session pursuant to Section 551.087 of the Texas Government Code to discuss economic development negotiations. At 6:44 P.M., President Charles Johnson recessed and convened in to an Executive Session pursuant to Section 551.071 and/or 551.087 of the Texas Government Code to seek the advice of the City's Attorney for pending or contemplated litigation and/or to discuss economic development negotiations. At 7:25 P.M., President Charles Johnson reconvened the meeting and announced that, in accordance with Section 551.102 of the Texas Government Code, no action was taken in Executive Session. a. Receive the Fiscal Year 2025-2026 Operating and Capital Budget for the Hyatt Regency Baytown-Houston. Finance Director Teresa McKenzie provided a summary regarding the Fiscal Year 2025-2026 Operating and Capital Budget. President Charles Johnson acknowledged the item was received. b. Consider a resolution adopting the Fiscal Year 2025-2026 Operating and Capital Budget for the Hyatt Regency Baytown-Houston. A motion was made by Director Sarah Graham and seconded by Director Jacob Powell to approve Resolution No. 501, as submitted. Consider a resolution authorizing Alliant Insurance Services, Inc., as broker, to secure agreements for insurance coverage policies for the Baytown Municipal Development District's property for Fiscal Year 2025-2026. Human Resources Director Joey Lopez provided an overview regarding the insurance coverage policies for the Baytown Municipal Development District's property. A motion was made by Director Sarah Graham and seconded by Director Kenrick Griffith to approve Resolution No. 502, as submitted. Consider approving the minutes of the City Council Special Budget Work Session Meeting held on August 5, 2025. b. Consider approving the minutes of the Regular Meeting of the City Council held on August 28, 2025. A motion was made by Council Member Sarah Graham and seconded by Council Member Laura Alvarado to approve Items 3.a., and 3.b., as submitted. PUBLIC HEARINGS a. Conduct a public hearing for a request concerning the proposed text amendment to Chapter 111, Unified Land Development Code (ULDC) of the Baytown Code of Ordinances to revise Sections 2.31, 2.34, and 7.25, for updates regarding Battery Energy Storage Systems. At 7:30 P.M., Mayor Charles Johnson opened the public hearing regarding Item 4.a., a request to the proposed text amendment to Chapter 111, Unified Land Development Code. (ULDC) Planning and Development Director Martin Scribner summarized the subject matter of the proposed text amendment. (Exhibit A) The Planning and Zoning Commission held the required public hearings with a few concerns from commission members. Mr. Scribner relayed the Planning and Zoning Commission has recommended denial. City Council Members requested clarification regarding the minimum requirements and expressed their recommendations regarding minimum requirements. At 7:49 P.M., Mayor Charles Johnson closed the public hearing regarding Item 4.a., a request to the proposed text amendment to Chapter 111, Unified Land Development Code. (ULDC) b. Consider an ordinance concerning the proposed text amendment to Chapter 111, Unified Land Development Code (ULDC) of the Baytown Code of Ordinances to revise Sections 2.31,2.34, and 7.25,for updates regarding Battery Energy Storage Systems. At 7:55 P.M., Mayor Charles Johnson opened the public hearing regarding Item 4.c., on a proposal to adopt a tax rate of$0.70042. Finance Director Teresa McKenzie provided a summary regarding the tax rate. (Exhibit B) Ceila Cravey, 4612 Country Club View, expressed her opinion and recommendations regarding the proposed tax rate. Marga Matthews, 606 East Republic Avenue, shared her recommendations regarding the no new revenue rate. City Council Regular Joint MDD Meeting Minutes September 25,2025 Page 6 of 20 Nicholas Rice, 9903 Pinehurst Street, expressed his concerns regarding the tax rate change and industrial district agreement impacts. David Issacs, 2812 Landmark Drive, shared his recommendations to support a rate closer to a no new revenue rate. At 8:09 P.M., Mayor Charles Johnson closed the public hearing regarding Item 4.c., on a proposal to adopt a tax rate of$0.70042. d. Consider an ordinance approving the ad valorem tax rate for the City of Baytown, Texas, for fiscal year ending September 30, 2026. Approval of the ordinance will set the property tax rate at$0.70042 per $100 valuation for the 2025 Tax Year. The General Fund maintenance and operations tax rate will be set at $.42703 per $100 valuation and debt service tax rate set at$.27339 per$100 valuation for fiscal year ending September 30,2026. City Council Members shared their recommendations regarding the tax rates and opinions regarding their purpose for serving on the City Council. A motion was made by Council Member Mike Lester to approve Item 4.d.; however motion died for lack of second. Mayor Charles Johnson announced the item failed. A motion was made by Mayor Pro Tem Jacob Powell and seconded by Council Member Sarah Graham to approve Ordinance No. 16,250, with amendment to adopt no new revenue rate at .69803. PROPOSED ORDINANCES a. Consider an ordinance amending the City of Baytown Utility Rates. Finance Director Teresa McKenzie provided an overview regarding the utility rates. Council Members expressed their concerns and recommendations regarding the rate change requirements. Public Works and Engineering Director Frank Simoneaux provided an overview regarding rates for water services. A motion was made by Council Member Laura Alvarado and seconded by Mayor Pro Tern Jacob Powell to approve Ordinance No. 16,251, with amendment of 3.89 for the first 2,000 gallons and rates schedule is per 1,000 gallons. Council Members shared their appreciation to the Parks and Recreation Department for their continuous efforts to grow and provide the community with a positive experience. City Attorney Scott Lemond clarified this ordinance will supersede the previous. A motion was made by Mayor Pro Tern Jacob Powell and seconded by Council Member Kenrick Griffith to approve Ordinance No. 16,252, as submitted. (Exhibit C) Council Members expressed appreciation to City Staff for their hard work and efforts to minimize additional traffic construction projects during this time. FOR THE BAYTOWN AREA WATER AUTHORITY RAW WATER PUMP REHABILITATION PROJECT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 6. PROPOSED RESOLUTIONS a. Consider a resolution adopting the City of Baytown Transparency Framework. Director of Public Affairs Thomas Reeves presented the City's new Transparency Framework and Axis webpage, defining transparency in Baytown as timely, proactive, and clear communication that provides residents access to accurate information from subject matter experts. Mr. Reeves highlighted existing transparency efforts such as Baytown Voice Magazine, Baytown Breakdown, Coffee with the City Manager, Reynolds on the Record, and the Council Listening Tour. Mr. Reeves announced the upcoming Envisio Performance Dashboard to provide real-time tracking of strategic goals and projects is scheduled to launch in October. (Exhibit D) City Council Members expressed their appreciation and recommendations regarding this new feature for the City to maintain transparency. We'll also have several contests and games this year with lots of prizes up for grabs. Please come out and enjoy a great night with the community. • Police Department o Shout-Outs to Officers Juan Navarro and Officer Jeffrey Spencer who were recently recognized by a community member for their outstanding response to a burglary. Here's what the citizen wrote in. "After months of extensive investigative work,the Baytown Police Department's Special Investigations Division(SID) executed a search warrant at a property located on E James Street. The operation led by Detective Edgar Avitia, culminated in the arrest of 3 individuals and the seizure of a significant quantity of illegal narcotics, firearms, and U.S. currency. Thank you to everyone involved for your outstanding professionalism and hard work! o Finally, I'd like to shout-out Officers Jeremy Stevens, Jeff Spencer, Teri Thompson, Justin Rouge, and Michael Nugent for their outstanding response to a recent 911 call involving a domestic violence situation. The caller reported that their abuser had unlawfully entered the home,barricaded the victim inside, and was hiding in a bedroom with their children. The officers acted with urgency and professionalism, and successfully de-escalated the situation. Their quick actions ensured the safety of the children and victim, and the suspect was safely taken into custody. This incident reflects the highest standards of courage and commitment to community safety. We're proud to have officers like you out in the field—thank you for everything you do. 10. COUNCIL MEMBER DISTRICT REPORT a. Receive a report from Council Member Laura Alvarado regarding projects, programs and events in District No. 1. Council Member Laura Alvarado reported the current projects, programs and events of District 1: • Planning& Development o The Market Street Reconstruction and West Baytown Drainage Improvements projects have both received federal grant funding and are awaiting amended agreements with Harris County. Led by a certified instructor,this free monthly Saturday class will offer guided use of labyrinth outside of the Center. • On September 13-14, the Center hosted the Eastern Rim Funny Book&Vintage Con, featuring comic and media guests, artists, authors,panels, and cosplay—providing family fun for all ages. • Public Works and Engineering o The Bayway Waterline Project will replace the existing line along Bayway Drive, which has been prone to frequent breaks. A design contract is expected to be presented to Council by November to initiate the design phase. • Police Department o A thank you to the Baytown Police Department for their participation in the back to school drive. • Public Works and Engineering o Idaho Street road pavement completed and a thank you to those making it possible. o Meeting with Texas Department of Transportation(TxDot) for potential grants for multiple road concerns that citizens have brought to our attention. • Food Town will be leaving the area for District 1 and District 2,but there is a potential site visit for another market. • Council Member Laura Alvarado wanted to welcome a new church, Gates of Praise (2701 W Main St.) into the city and a farewell to another ministry, Saint Pauls Lutheran Church. • Residents have brought to my attention lighting for a pickle ball area and walking paths. • Stuart Career Tech High School hosted their 2nd Hispanic Heritage Month. • A reminder to attend the Grito Fest October 4`h. 11.
