AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE BAYTOWN HAZARDOUS WASTE COLLECTION DAY
TENTATIVELY SCHEDULED FOR SATURDAY DECEMBER 13, 2025;
AUTHORIZING PAYMENT NOT TO EXCEED ONE HUNDRED THOUSAND
NO:100 DOLLARS ($100,000.00) TO CLEAN EARTH ENVIRONMENTAL
SOLUTIONS, INC., FOR TRANSPORT AND DISPOSAL OF HOUSEHOLD
HAZARDOUS WASTE ITEMS,THROUGH A COOPERATIVE PURCHASING
AGREEMENT WITH THE HOUSTON-GALVESTON AREA COUNCIL (H-GAC);
MAKING OTHER PROVISIONS RELATED THERETO;AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement for
cooperative purchasing with the Houston-Galveston Area Council (H-GAC); and
WHEREAS, pursuant to such agreement, the City may make purchases based upon the bids
received and the negotiated contract entered into by the H-GAC; and
WHEREAS, the H-GAC has taken bids and entered into a contract for transport and disposal of
household hazardous waste items from and with Clean Earth Environmental Solutions, Inc.; NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown hereby authorizes the Baytown Hazardous
Waste Collection Day tentatively scheduled for December 13, 2025 and authorizes the payment to Clean
Earth Environmental Solutions, Inc. not to exceed ONE HUNDRED THOUSAND AND NO."100
DOLLARS ($100,000.00), for transport and disposal of household hazardous waste items through a
cooperative purchasing agreement with the Houston-Galveston Area Council.
Section 2: That pursuant to the provisions of the Texas Local Government Code Annotated Section
252,048, the City Manager is hereby granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTY THOUSAND AND NO 100 DOLLARS ($50,000.00) or less,
provided that the original contract price may not be increased by more than twenty-five percent (251}0) or
decreased by more than twenty-five percent(25°-0) without the consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
