Ordinance No. 16,300 (Item 7.c.)ORDINANCE NO. 16,300 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING A BASE RATE PRICE ADJUSTMENT OF 5.40, FOR THE FOURTH YEAR OF A FIVE-YEAR CONTRACT WITH BEST TRASH, LLC. FOR ANNUAL RESIDENTIAL SOLID WASTE COLLECTION, DISPOSAL, AND RECYCLING SERVICES; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN AN AMOUNT NOT TO EXCEED SEVEN-MILLION, TWO-HUNDRED EIGHTY-ONE THOUSAND, FIVE-HUNDRED NINETY-NINE AND 281100 DOLLARS 7,281,599.28); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes a base rate price adjustment of 5.4% for the fourth year of a five-year contract with Best Trash, LLC. ("Best Trash") for annual residential solid waste collection, disposal, and recycling services, based on the twelve month percent change as reported in the Consumer Price Index-All Urban Consumers, Series ID: CUSROOOOSEHGO2 Garbage and Trash Collection A copy of Best Trash's Renewal Letter exercising its right to an automatic yearly price adjustment is attached hereto as"Exhibit A' and incorporated herein for all intents and purposes. Section 2: That the City Council hereby authorizes payment to Best Trash in an amount not to exceed SEVEN-MILLION, TWO-HUNDRED EIGHTY-ONE THOUSAND, FIVE-HUNDRED NINETY-NINE AND 28::]00 DOLLARS ($7,281,599.28), in accordance with the increase in base rates of said contract authorized to Section 1. Section 3:That pursuant to the provisions of Texas Local Government Code Annotated 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO1100 DOLLARS ($50,000.00) or less, subject to the provision that the original contract price may not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease.
