2023 12 20 CC Minutes Special MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN December 20, 2023 The City Council of the City of Baytown,Texas,met in a Special Meeting on Thursday, December 20, 2023, at 4:37 P.M. in the Council Chamber of the Baytown City Hall at 2401 Market Street, Baytown, Texas, with the following in attendance: Laura Alvarado Council Member Sarah Graham Council Member Kenrick Griffith Council Member Jacob Powell Council Member Brandon Capetillo Mayor Jason Reynolds City Manager Scott Lemond City Attorney Angela Jackson City Clerk John Stringer Sergeant at Arms Mayor Pro Tem Lester convened the December 14, 2023, City Council Regular Meeting with a quorum present at 4:37 P.M. All members were present with the exception of Mayor Pro Tern Mike Lester. The Pledge of Allegiance, Texas Pledge, and Invocation were led by Council Member Alvarado. 1. RUNOFF ELECTION CANVASS a. Canvass the returns of the City of Baytown's December 9, 2023 Runoff Election. City Clerk,Angela Jackson presented the tabulation results to Council from the December 9,2023, runoff election for District 4. Mayor Capetillo presented the results as follows: VOTER SUMMARY NUMBER OF VOTERS TOTAL BALLOTS CAST 504 TOTAL PROVISIONALLY BALLOTS/REJECTED/ACCEPTED 1 TOTAL NUMBER OF REGISTERED VOTERS 6,147 VOTER TURNOUT 8.18% General Election Summary City Council Special Meeting Minutes December 20,2023 Page 2 of 5 VotinMayor Ballot By Mail Early Voting Election Day TOTAL Harris Harris Harris Harris Kim Kosteck 9 137 87 234 46.43% Candidates James Franco 9 165 96 270 53.57% Totals: 18 302 183 504 100.00% Council Member- District#4 Canvass Totals* Kim Kosteck 234 James Franco 270 Total Votes Cast 504 Mayor Capetillo concluded the canvas by returning the results to the City Clerk. b. Consider an ordinance declaring the results of the City of Baytown Runoff Election held on Saturday, December 9, 2023. Motion was made by Council Member Jacob Powell and seconded by Council Member Sarah Graham approving Ordinance No. 15,671,related to Item l.b. The vote was as follows: Ayes: Mayor Brandon Capetillo, Council Member Laura Alvarado, Council Member Sarah Graham, Council Member Kenrick Griffith, Council Member Jacob Powell, Nays: None Other: Mayor Pro Tern Mike Lester(Absent) Approved ORDINANCE NO. 15,671 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAY- TOWN, TEXAS, DECLARING THE RESULTS OF THE MUNICIPAL RUNOFF ELECTION HELD DECEMBER 9,2023,CONCERNING THE ELECTION OF A COUNCIL MEMBER FOR DISTRICT NO. FOUR (4) OF THE CITY OF BAYTOWN; AND PROVIDING FOR THE EFFEC- TIVE DATE THEREOF. 2. MINUTES a. Consider approving the minutes of the City Council and Baytown Municipal Devel- opment District Joint Special Meeting held on October 26, 2023. City Council Special Meeting Minutes December 20,2023 Page 3 of 5 b. Consider approving the minutes of the City Council Work Session and Regular Meeting held on October 26,2023. A motion was made by Council Member Sarah Graham and seconded by Council Member Jacob Powell to approve Items 2.a. and 2.b. The vote was as follows: Ayes: Mayor Brandon Capetillo, Council Member Laura Alvarado, Council Member Sarah Graham, Council Member Kenrick Griffith, Council Member Jacob Powell, Nays: None Other: Mayor Pro Tem Mike Lester(Absent) Approved 3. CITIZEN COMMENTS Mayor Capetillo announced no citizen had signed up to speak on the Citizen Comments item. 4. EXECUTIVE SESSION a. Recess into and conduct an executive session pursuant to Section(s) 551 .071 and/or 551.087 of the Texas Government Code to seek the advice of the City's attorneys and/or to discuss economic development negotiations. PROPOSED ORDINANCES a. Consider an ordinance authorizing funding for the engagement of Husch Blackwell LLP to advise on economic development and general legal matters. A motion was made by Council Member Kenrick Griffith and seconded by Council Member Sarah Graham to approve Ordinance No. 15,672, related to Item 5.a. The vote was as follows: Ayes: Mayor Brandon Capetillo, Council Member Laura Alvarado, Council Member Sarah Graham, Council Member Kenrick Griffith and Council Member Jacob Powell, Nays: None City Council Special Meeting Minutes December 20,2023 Page 4 of 5 Other: Mayor Pro Tem Mike Lester(Absent) Approved ORDINANCE NO. 15,672 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING FUNDING FOR THE ENGAGEMENT OF HUSCH BLACKWELL LLP,TO ADVISE ON ECONOMIC DEVELOPMENT AND GENERAL LEGAL MAT- TERS, IN AN AMOUNT NOT TO EXCEED FIFTY THOUSAND AND NO/100 DOL- LARS ($50,000.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 6. CONSENT A motion was made by Council Member Jacob Powell and seconded by Council Member Sarah Graham to approve Consent Agenda Items 6.a. The vote was as follows: Ayes: Mayor Brandon Capetillo, Council Member Laura Alvarado, Council Member Sarah Graham, Council Member Kenrick Griffith, and Council Member Jacob Powell, Nays: None Other: Mayor Pro Tern Mike Lester(Absent) Approved a. Consider an ordinance authorizing the First Amendment to the Collective Bargaining Agreement with the Baytown Professional Firefighters' Association. ORDINANCE NO. 15,673 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAY- TOWN, TEXAS, AUTHORIZING THE FIRST AMENDMENT TO THE COLLECTIVE BARGAINING AGREEMENT WITH THE INTERNA- TIONAL ASSOCIATION OF FIREFIGHTERS LOCAL 1173; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 7. MANAGER'S REPORT City Manager Jason Reynolds thanked the Mayor and Council and the Citizens of Baytown for a won- derful year and wished everyone a happy holiday and new year.
