AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF BAYTOWN TO
REZONE APPROXIMATELY 10.00 ACRES GENERALLY LOCATED ON THE
SOUTH SIDE OF E. WALLISVILLE ROAD AND EAST OF N. MAIN STREET, AT
6526 E.WALLISVILLE ROAD, LEGALLY DESCRIBED AS TRACT 8B,ABSTRACT
21 G, ELLIS, HARRIS COUNTY, TEXAS, FROM OPEN SPACE/RECREATION (OR)
TO A GENERAL COMMERCIAL (GC) ZONING DISTRICT; PRESCRIBING A
MAXIMUM PENALTY OF TWO THOUSAND AND NO. 100 DOLLARS ($2,000.00);
PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND
PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1: That the City Council of the City of Baytown,Texas, hereby amends the official zoning
map of the City of Baytown to effectuate zoning district changes for approximately 10.00 acres generally
located on the south side of E. Wallisville Road and east of N. Main Street, at 6526 E. Wallisville Road,
legally described as Tract 813,Abstract 21 G,Ellis,Harris County,Texas,from Open Space Recreation(OR)
Zoning District to a General Commercial (GC)Zoning District.The amended portion of the official zoning
map is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes.
Section 2: Any person who fails to comply with any provision of this ordinance shall be guilty of
a misdemeanor and, upon conviction, shall be punished by a fine not exceeding TWO THOUSAND AND
NO.;100 DOLLARS ($2,000.00). Each act of violation and each day upon which any such violation shall
occur shall constitute a separate offense. In addition to the penalty prescribed above, the City may pursue
other remedies such as abatement of nuisances,injunctive relief,administrative adjudication and revocation
of licenses or permits.
Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are
hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency, and
in all other respects, this ordinance shall be cumulative of other ordinances regulating and governing the
subject matter covered by this ordinance.
Section 4: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase
of this ordinance or the application of same to any person or set of circumstances shall for any reason be
held unconstitutional,void or invalid,such invalidity shall not affect the validity of the remaining provisions
of this ordinance or their application to other persons or sets of circumstances;and to this end,all provisions
of this ordinance are declared to be severable.
Section 5: This ordinance shall take effect from and after ten (10) days from its passage by the
City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this
ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10)
days after passage of this ordinance.

DESCRIPTION of a 10.0035 acre tract of land situated in the George Ellis League,Abstract 21, Harris
County, Texas and being out of and a part of Lot 8 of the Subdivision of the George Ellis league as
recorded in Volume 72 at Page 459 of the Deed Records of Harris County,Texas. Said 10.0035 acres
being all of that same land (called 10.000 acres)conveyed by M.S.Young Co., Inc.to Eagle Nest Business
Park, Ltd. by Deed dated August 18, 2003 and recorded under County Clerk's File#W947360 of the
Official Public Records of Real Property of Harris County,Texas. This 10.0035 acre tract of land is more
particularly described by the following metes and bounds,to-wit:

way)for the Northwest corner of that certain 81.589 acres conveyed by Chevron Phillips Chemical
Company LP to City of Baytown by Deed dated December 20, 2018 and recorded under County Clerk's
File#RP-2018-569858 of the Official Public Records of Real Property of Harris County,Texas and the
Northeast corner and POINT OF BEGINNING of this tract. Said BEGINNING POINT has a State Plane
Coordinate Value of Y=13,869,646.79 and X=3,249,104.57.
THENCE: South 12°09'48" East along the East line of this tract and the West line of said 81.589 acres for
a distance of 1750.36 feet to a 1-1/4 inch galvanized iron pipe for the Southeast corner of this tract and
the Easternmost Northeast corner of that certain 13.5043 acres conveyed by Efrain Garcia to City of
Baytown by Deed dated February 3, 2014 and recorded under County Clerk's File#20140049797 of the
Official Public Records of Real Property of Harris County,Texas. Said point has a State Plane Coordinate
Value of Y=13,867,935.92 and X=3,249,473.44.
THENCE: South 77°52'47"West along the South line of this tract and the Easternmost North line of said
13.5043 acres for a distance of 248.98 feet to a point for the Southwest corner of this tract and the
Southeast corner of that certain 17.2435 acres conveyed by Efrain Garcia to City of Baytown by Deed
dated May 20, 2016 and recorded under County Clerk's File#RP-2016-246562 of the Official Public
Records of Real Property of Harris County,Texas.
THENCE: North 12°09'48"West along the West line of this tract and the East line of said 17.2435 acres
for a distance of 1749.93 feet to a % inch galvanized iron pipe in the South right-of-way line of said
Wallisville Road for the Northwest corner of this tract and the Northeast corner of said 17.2435 acres.
THENCE: North 77°46'43" East along the North line of this tract and the South right-of-way line of said
Wallisville Road for a distance of 248.98 feet to the PLACE OF BEGINNING and containing within these
