AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN APPROVING
CHANGE ORDER NO. 1 TO THE AGREEMENT BETWEEN THE BAYTOWN AREA
WATER AUTHORITY AND LEM CONSTRUCTION COMPANY, INC. FOR THE
BAYTOWN AREA WATER AUTHORITY RAW WATER PUMP REHABILITATION
PROJECT;MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR
THE EFFECTIVE DATE THEREOF.

WHEREAS, the Baytown Area Water Authority's enabling legislation requires that the City Council
approve contract before the Baytown Area Water Authority enters into the same;
WHEREAS, on September 17, 2025, the Board of Directors of the Baytown Area Water Authority met
and authorized Change Order No. 1 with LEM Construction Company, Inc., for the Baytown Area Water
Authority Raw Water Pump Rehabilitation Project; and
WHEREAS, the City of Baytown desires to approve the same; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN:
Section 1: That the City Council of the City of Baytown hereby approves the Change Order No. 1
to the agreement between the Baytown Area Water Authority and LEM Construction Company, Inc., for the
Baytown Area Water Authority Raw Water Pump Rehabilitation Project.
Section 2: That, subject to staff's confirmation regarding the applicability of sales tax to Change
Order No. 1, the City Council of the City of Baytown does hereby authorize Change Order No. 1 with LEM
Construction Company, Inc., for the Baytown Area Water Authority Raw Water Pump Rehabilitation Project.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown, Texas.
