The City Council and Baytown Municipal Development District (MDD) of the City of Baytown
met in a Meeting on Thursday, June 26, 2025, at 6:30 P.M. in the Council Chamber of the
Baytown City Hall at 2401 Market Street, Baytown, Texas, with the following in attendance:

Mayor / President Charles Johnson convened the June 26, 2025 City Council and Municipal
Development District (MDD) Joint Meeting with a quorum present at 6:31 P.M. All members
were present.
The Pledge of Allegiance, Texas Pledge and Invocation were led by Council Member i Director
Laura Alvarado.
Mayor Charles Johnson took a point of privilege to recognize former Mayor Zimmerman of
Sugarland and former Council Member Chris Presley for District 2. Thank you for attending
today's Council Meeting.
1. CITIZEN COMMENTS
Mayor / President Charles Johnson announced citizens signed up to speak.
Harvey Ponder, 6403 Crosby Cedar Bayou Rd. stated, "Mr. Mayor I agree wholeheartedly
everyone should learn what Juneteenth and emancipation means. They should learn that at one
time we as a country counted some men as three -fifths of a man and how some people were
bought and sold based solely on the number of teeth they had in their mouth. We should all learn
about the struggles and accomplishments of Frederick Douglas, George Carver, Jackie Robinson
and Rosa Parks. That a man should be judged by the content of his character not by the color of
his skin. What we should also learn is that while our Country has had and still has many other
faults and problems it has brought this world some ideas and concepts never before realized.

Like how we the people choose our leaders and those officials should lead with the consent of
the government. The simple fact that I am here right now and confide grievances with those
officials without fear of persecution, are principles that most people in this world have never
even heard of. That's the reason for the 4th of July. Let me tell you about a friend of mine a
special forces green beret airborne ranger with a combat infantryman's badge and too many
medals to count. These are the last strikes he wore as a buck sergeant in the army and the first
ones that I wore. I held him in my arms as he cried about men who died in his arms and how he
had to pick up friends of his through 2 tours of Vietnam and never ask about their skin tone. You
got to know him, he often jokes that what made him such a good soldier was that you can't see
him unless he smiled and nobody smiles when you're getting shot at. He was a dark-skinned
black man who loved this country and would party with anybody even a skinny white kid from
Backwater Mississippi. I will be at Bicentennial Park next week celebrating the birth of the
greatest country in the world looking for more loud booms, more star clusters across the sky and
thinking about how blessed 1 am to be an American. Thank you."
June Stansky, 4601 Driftwood Dr. stated, "I was so happy to see the City of Baytown and Cliff
and his crew at the Parks Department put on a fantastic Juneteenth festival and he will do so for
of course July the 4th. The music was wonderful. There was a program on the history of
Juneteenth which wasn't music. It was actually guest speakers which was very informative,
because I was at the council meeting before the program somebody mentioning that we should
have the history lesson and it was there. I was disappointed that there was not a stronger police
presence on the vendors street, because there were some rowdy teenagers and they were not
handled till the end of the evening but they should have had a more visible presence there on the
vendor street."
Susan Cummings, 2102 Sheridan Dr. stated, "I'm happy to be here, I come tonight to encourage
City Council to build on the success of the City's partnership with the Harris County Transit
Authority. Recently the Baytown West Chambers County Economic Development Foundation
touted the milestone of 1 million rides completed on Baytown Harris County circulator routes
that began in 2008. We should all celebrate. Transportation services add to the quality of life for
riders by providing access to local jobs, amenities and retail stores. Our whole City benefits from
the circulator routes because they reduce the number of vehicles clogging our roads and adding
to our poor air quality. In addition, we should remember who and what we are. A blue-collar
town with nearly 18 percent of our population living in poverty according to the U.S census and
a walkability score of 33 on a scale of 100. I hope you will continue to support this program,
many people depend on it. Thank you."
City Manager!' General Manager Jason Reynolds entered the meeting at 6:42 P.M.
Meyaconnie Williams, 8006 Berkley Ct. stated, "I was coming to say that I appreciate the
sidewalks that we have near my home. I use it for recreational use, I walk my dogs. However
other pedestrians use it for their transportation. What I've noticed is an increase of litter and
when it's time to mow the lawn the litter is not picked up prior so the litter multiplies. I was
going to ask or recommend that we put trash bins. They're not there now so they're not using it,
I'm not saying that they're going to use it when it comes, but they don't even have that option
right now. When you're walking the area it's not feasible to the eyes to see especially when this is

your community and you want to keep it up. That was just a recommendation to maybe put trash
bins. As she mentioned the bus routes are there so they're going to these places, but the trash is
not going where it needs to. There is nowhere for them to put it."
Troy Whiteneck, 9946 Bayou Woods Dr. stated, "There's rumors that the Council wants to
cancel Juneteenth. One of the arguments is it attracts undesirables like Jaylen Molina from
Galveston, who came. This is her second year in a row, Dr. Regina Sims from La Porte, who
wrote a children's book about Juneteenth, and Nicholas and Patricia Thompson from the United
Kingdom and they want to come back next year. They use the public library to Iearn more about
black history. They had nothing but good things to say about the Juneteenth celebration. They're
taking some of the music they heard back with them. They did criticize a need for more
sidewalks and a lack of public transportation in general. Jason Calder the Baytown spokesperson
said the police officers are professional. He forgot to mention that a group of police officers
mocked a group of law-abiding citizens."
Dick Olin, 3627 Clover Valley Dr. Kingwood, TX stated, "I lived in Baytown for 17 years
before I moved. I'm here asking for support for the Bayou Bowl. The Bayou Bowl was a game
that started in Baytown in 2003, it was here to 2013 and then recommended by, at that time,
Mayor DonCarlos that we start alternating cities. We did that, the game's been played in Sugar
Land, Katy, Kingwood, League City. It's been played in 5 other communities plus Baytown, it is
presently in Mont Belvieu. What I'm here for is to ask the financial support of the City for
$15,000 for the production cost of the game. The game is televised live on Sports City Home
Network which is a network that broadcasts Astros, NBA games, the Rockets and other things as
far as soccer and world soccer. The game would be televised there as well as Dave Campbell
Texan Live. The City would receive a 30 second ad on tv along with a program ad. All the
money generated goes to scholarships for boys and girls. This year we gave out $1,500
scholarships and contributed $9,000 to benevolence fund. We are a total 501(c)(3) organization
and everyone is a volunteer. I would be happy to come back and talk to you further about the
game and the production of the game. I know you can't ask questions now but I would be happy
to answer any at a later date. The game was a Baytown game for a long time. We do stay in your
community and have for the past four years at the Holiday Inn and the Hampton Inn. The people
now are playing east Texas and those people do come and stay in our community. Anytime I
would come back I'd be very happy to visit with anyone about it. Thank you very much for your
time and the extension."

Donna Mohlman, 2201 Tuscan Ln. stated, "First I want to thank City Council members for
promoting community engagement and celebration by providing high quality community events
such as Juneteenth, July 4th, the Grito Fest and the Nurture Nature Festival. These opportunities
not only celebrate our diverse heritage but also weave each social thread to create a beloved
community. I attended the Juneteenth celebration in Bicentennial Park, reconnecting with
friends, neighbors and church members to celebrate freedom. The music was loud enough to
enjoy without overpowering conversations. The only negative thing for me was the number of
unsupervised teenagers running through the crowds, chasing each other while they were videoing
with their phones but this can be found with any venue that has unsupervised teens. I was
surprised to learn some residents want to discontinue the celebration due to the cost and not their
taste in music. I would hope all Baytonians could support a celebration of the end of chattel
slavery. We have much more work to do to end economic slavery and systemic injustice. I
believe if you think you love freedom but you don't care if it applies to everyone what you
actually love is privilege. Finally, I choose to live work and play in Baytown because our city
provides clean waters, parks, trail, community events and the best municipal library in the
country resulting in high duality of life. Quality of life is not necessarily profitable nor should it
be. Thank you."
Rhonda Lopez, 704 Littlewood stated, "Good evening, Mayor, council and city staff. I'm here as
a resident and advocate for our community's commitment and our community's continued
investment in our public transportation services. I urge you to walk back any thoughts of ending
our public transportation program, which has become a vital service for thousands of residents
including seniors, students, low-income families and people with disabilities. Cutting this service
would have real and immediate consequences for those who rely on it every day. This isn't
simply a matter of transportation. It's about access, equity and economic survival. For many
people in our community the bus is the only way to get to work, to school, to the grocery store or
to medical appointments. Not everyone can drive nor can everyone afford a car. The bus is how
people live their lives. I understand the city faces budget challenges but cutting this bus program
is not the solution, it's a short-term decision with long-term harm. Please preserve this essential
public service. Thank you."
Janeice Carroll, 3210 Indian Trail stated, "Tonight I would like to address the Baytown auto
storage situation, I unfortunately was in an accident the 24`h of May, which required my car to be
towed. While it was towed there for 24 hours, we tried to get access to it, that was a Friday
evening, we were told it was not available until Monday. My husband went by and by chance
somebody was there so he walked in there and they let him go back there to get our stuff. Now I
had to be cut out of the car so the car was quite open. They did not secure the vehicle. If you'll
flip through the packet, raccoons went through my car, they overcharged and are they
overcharging everybody? I would have to say that our contract with them is not doing the city
any good and this is exactly what happens when monopolies occur."

Finance Director Teresa McKenzie provided an overview regarding the MDD fiscal year 2025-
2026 Proposed Budget.
President Charles Johnson acknowledged the report was received.
d. Consider a resolution setting a public hearing regarding the Baytown Municipal
Development District's Fiscal Year 2025-2026 Proposed Budget.
President Charles Johnson announced the first public hearing will be held on July 24, 2025.
A motion was made by Director Laura Alvarado and seconded by Jacob Powell to approve
Resolution No. 495, as submitted. The vote was as follows:

Human Resources Director Joey Lopez presented a video recognizing the May Years of Service
awardees, noting there were none for July.

b. Receive and discuss a presentation by Fidelis Realty Partners regarding their
commercial development, San Jacinto Marketplace.
The citizen that signed up to speak waived their time due to the absence of a presentation.
Mayor Charles Johnson informed the City Council Item 4.b., regarding the Fidelis Presentation
will be moved to a future meeting and Item 9.a., regarding the Baytown Citizen Bond Advisory
Committee will be taken out of order to receive the report.
Citizen Bond Advisory Committee Chair Gilbert Santana provided an update of the Bond
Committee indicating there are 15 members committed to serving the City and making a positive
impact. The committee currently has no recommendation.
Council Members and Staff expressed appreciation to the committee members for their time and
effort in reviewing the projects list.
5. PUBLIC HEARINGS
a. Conduct a second public hearing regarding the Strategic Partnership Agreement
with Chambers County MUD No. 1

Agreement.
At 7:20 P.M., Mayor Charles Johnson closed the public hearing regarding Item 5.a., the Strategic
Partnership Agreement with Chambers County.
b. Conduct the first public hearing regarding the proposed voluntary annexation of
approximately 19.86 acres at 5401 Interstate Highway 10 (IH 10).
At 7:21 P.M., Mayor Charles Johnson opened the public hearing regarding Item 5.b., the
proposed voluntary annexation of approximately 19.86 acres.
Planning and Development Services Director Martin Scribner provided a presentation regarding
the Voluntary Annexation of 5401 IH 10. (Exhibit A)
At 7:23 P.M., Mayor Charles Johnson closed the public hearing regarding Item 5.b., the
proposed voluntary annexation of approximately 19.86 acres.
C. Conduct the second public hearing regarding the proposed voluntary annexation of
approximately 19.86 acres at 5401 Interstate Highway 10 (IH 10).
At 7:24 P.M., Mayor Charles Johnson opened the public hearing regarding Item 5.a., the
Strategic Partnership Agreement with Chambers County.
Planning and Development Services Director Martin Scribner provided the following steps for
the Voluntary Annexation of 5401 11-1 10.
Council Member James Franco expressed his appreciation to the developer's interest in the City
of Baytown for and providing more homes to residents of Baytown.
At 7:25 P.M., Mayor Charles Johnson closed the public hearing regarding Item 5.a., the Strategic
Partnership Agreement with Chambers County.

a. Consider an ordinance calling the City of Baytown General Election to be held on
November 4, 2025, for the purpose of electing Council Members from District 1, 2, and 3.

a. Consider an ordinance authorizing a Chapter 212 Agreement between the City of
Baytown and NRG Texas Power LLC, including provisions for payments to the City and
capital expenditure -based incentives.
Economic Development Manager Brian Moran introduced the item indicating Kroll and NRG
representatives were present to provide further detail regarding Item 7.a., an ordinance to
authorize Chapter 212 Agreement.
Tony Schum, Kroll Managing Director for Site Selection and Incentive practice, provided an
overview of the 212 Agreement between City of Baytown and NRG Texas Power LLC.

Economic Development Manger Brian Moran provided an overview regarding the extension or
renewal of an Industrial District Agreement.

City Attorney Scott Lemond provided an overview regarding the amendment of Chapter 2 of
City Contracts.

Planning and Development Martin Scribner provided a summary regarding the amendment of a
development agreement for the previously named Heights of Baytown, changed to Heights of

Americus Holdings Representative Nathan Watkins provided an overview of the development
agreement for the Heights at Barbers Hill.
Council Members expressed concerns for kennels, housing accommodations and available
emergency services.

12. MANAGER'S REPORT
City Manager Jason Reynolds presented the Manager's Report:
• Public Works and Engineering Department
o Hector Alvarez from PWE for recently obtained his TCEQ Groundwater
Class C License. He also participated in several events at the TPWA
Equipment Rodeo and took 1 st place in the backhoe event.
• Public Affairs
o Baytown's Grito Fest was recently named the 2025 Texas Travel Award
winner for "Small to Mid -Market Community Event." With this recognition,
all three of Baytown's concerts are now officially award -winning. Special
thanks to Jason Calder in Public Affairs for preparing the award submission.
• Human Resources
o Ava Hudnall from Human Resources recently passed her Society for Human
Resources certified professional exam. This is a nationally recognized
certification and the HR industry's highest standard credential.
• Thanks to the Parks and Recreation Tourism Team, Police Department, Fire
Department, Harris County Constables, the Committee, Public Works
Department and volunteers for the contribution to ensure the Juneteenth Event
took place and went well.
• Baytown Junior All -Stars are officially the District 14 Champions the boys
showed up and showed out and brought home the trophy.
• July 41h Event will take place next week and we want to see everyone out there.
13. COUNCIL MEMBER DISTRICT REPORT
a. Receive a report from Council Member Laura Alvarado regarding projects,
programs and events in District No. 1.
Council Member Laura Alvarado reported the current projects, programs and events of District
1:
• Planning & Development
o A new Heavy Hitters Batting Cage Facility at 108 Schilling Ave.
o Sky Zone Indoor Trampoline Park at 3501 Garth Rd is halfway complete.
• Parks and Recreation
o Since June 24, Calypso Cove has welcomed 5,662 patrons and generated
$58,985 in revenue, including $2,800 from food sales.

o In June, Parks and Recreation hosted a virtual scavenger hunt at Bergeron
Park using an augmented reality app called Agents of Discovery. Players
used their phones to explore the park, interact with features, and complete
fun missions, all while getting outside and staying active. This month, 96
game plays were reported at Bergeron. Since the program began in March,
a partnership with Be Well Baytown, there have been a total of 774 game
plays.
■ West Baytown Civic Association has revived their yard of the month to
encourage neighborhood pride. Previous winner Mr. Mott appreciated so many
compliments and calls received. The new winners for the month of June was
Mr. and Mrs. Almaraz.
■ This past weekend Exxon imploded their white house and everyone
appreciated the work in this process and wanted to inform the City of Baytown
there are no current plans to use the lot, but will infill it for the time.
■ East Harris County Manufacturers Association meeting held was to discuss
project of 2025. Harris County Toll Road will work in connection to Beltway 8
starting in 2026.
■ A San Jacinto bridge replacement will be coming, but no known date at the
moment. You can find more information on the Texas Department of Public
Transportation.
■ Council Member Laura Alvarado and Council Member Sarah Graham have
been attending a Community Emergency Response Team course in
preparation.
■ Market Street reconstruction received approval to move on to the next step and
looks forward to the progression.
14. EXECUTIVE SESSION
a. Recess into and conduct an executive session pursuant to Section(s) 551.071 and/or
551.087 of the Texas Government Code to seek the advice of the City's attorneys and/or to
discuss economic development negotiations.
b. Recess into and conduct executive session pursuant to Texas Government Code,
Section 551.074 to deliberate the annual performance evaluation and duties of the City
Manager.
At 8:41 P.M., Mayor Charles Johnson recessed and convened in to an Executive Session
pursuant to Section(s) 551.071 and/or 551.087 and/or 551.074 of the Texas Government Code to
seek the advice of the City's attorneys and/or to discuss economic development negotiations
and/or to deliberate the annual performance evaluation and duties of the City Manager.
At 10:47 P.M., Mayor Charles Johnson reconvened the meeting and announced that, in
accordance with Section 551.102 of the Texas Government Code, no action was taken in the
Executive Session.
