2025 02 13 CC MinutesMINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN February 13, 2025 The City Council of the City of Baytown, Texas, met in a Regular Meeting on Thursday, February 13, 2024, at 6:30 P.M. in the Council Chamber of the Baytown City Hall at 2401 Market Street, Baytown, Texas, with the following in attendance: Sarah Graham Mayor Pro Tern Laura Alvarado Council Member Kenrick Griffith Council Member James Franco Council Member Jacob Powell Council Member Mike Lester Council Member Charles Johnson Mayor Jason Reynolds City Manager Scott Lemond City Attorney Angela Jackson City Clerk John Stringer Sergeant at Arms Mayor Charles Johnson convened the February 13, 2025 Regular City Council Meeting with a quorum present at 6:34 P.M. All members were present. The Pledge of Allegiance, Texas Pledge, and Invocation were led by Council Member Jacob Powell. 1. CITIZEN COMMENTS Mayor Charles Johnson announced citizens signed up to speak. a. Don Akey, 410 Lakewood stated "I'm here to speak about pollution mainly. I started in 2021 to try to get playgrounds cleaned up and get the toxins away from our children and to get the City to follow the law. Since I'm known for never saying anything nice, I want to say something nice now. They cleaned up the playground on Allenbrook, but that's the end of the nice stuff. They've been working for over 1100 days. They still have playgrounds that are not part of this. I'm hoping they can get them done before 1200 days. It's an insult to say that the City actually put up with that. Second thing, the boil water alert concern. I called the City Public Works yesterday morning and they said, we absolutely don't need to boil water. I knew that was wrong since my major is in environmental science. I called the Texas Commission on Environmental Quality (TCEQ) in Austin and they said yes, they need to implement the boil water notice. 1 called (TCEQ) in Houston and left them a detailed message. Apparently, they made you do it as your own words say they were required by the TCEQ to implement the boil water. Most people in eighth grade 1 earn that." City Council Regular Meeting Minutes February 13, 2025 Page 2 of 16 b. Harvey Ponder, 6403 Crosby Cedar Bayou Road, stated "I won't be that long tonight, I don't think. First, I'd like to say thank you to all as well as Mayor Johnson, Councilman Franco, City Manager Jason Reynolds, Fire Chief Dobson, Emergency Coordinator Almia and the other City employees who responded to the recent fire and explosion off of Main Street last December. I'd just like to say thank you for all of your professionalism, expertise, care and compassion. There were a few missteps in the start, but those were addressed. I'd just like to say thank you again for taking care of me and my family, I really appreciate it. At Councilman Franco's listening tour my neighbors and I had a passionate and what I believe profitable discussion about the fire and some other things. That was appreciated as well, it shows some integrity. On a personal note, Mr. Reyn- olds thank you. Secondly, I just paid my tax bill for 2024 at $1,454.28 for an average of $8,000 since 2017 when we were annexed. Folks you all want my money, but you cannot give me what you promised you'd give me. With the current financial situation in Baytown I don't think you ever will have the money. The City admitted to being hasty and made errors with their annexation process in 2017. After this year of discussion, you gave me a detailed list of requirements needed to make for deannexation. Along with other stipulations that must be followed to the letter. Why is it the City can make errors? I was given a list of detailed instructions that I have to follow. Would any or all of you give me a detailed list of expenditures that you all made last week on your finan- cial retreat? I'd like to see it, that's all I got. Thank you." 2. RECOGNITIONS AND CITIZEN COMMUNICATIONS a. Present a proclamation designating February 16 - 22, 2025, as National Engineers Week in Baytown. Mayor Charles Johnson, read the proclamation designating February 16 - 22, 2025 as National Engineers Week in Baytown. 3. PUBLIC HEARINGS a. Conduct a public hearing concerning the rehabilitation by Atrium Bay Terrace, LP, of Bay Terrace Apartments, an approximately 130-unit affordable rental housing complex, located at 1502 Nolan Road, Baytown, Harris County. At 6:46 P.M., Mayor Charles Johnson opened the public hearing regarding Item 3.a., the rehabilitation by Atrium Bay Terrace, LP, of Bay Terrace Apartments. Planning and Development Services Director Martin Scribner provided a presentation regarding Item 3.a., to rehabilitate the Bay Terrace Apartments. At 6:49 P.M., Mayor Charles Johnson closed the public hearing regarding Item 3.a., the rehabilitation by Atrium Bay Terrace, LP, of Bay Terrace Apartments. b. Consider a resolution registering support to Atrium Bay Terrace, LP to apply for the 4% and 9% Low Income Housing Tax Credit (LIHTC) through the Texas Department of Housing and Community Affairs (TDHCA) to rehabilitate Bay Terrace Apartments. PROPOSED ORDINANCES a. Consider an ordinance authorizing an Agreement with CoolxDad Inc. to lead Baytown's fatherhood initiative. Director of Public Affairs Thomas Reeves provided a summary regarding CoolxDad program that was introduced to the City of Baytown during the Work Session. Council Members expressed their excitement for what the program can bring to the community and appreciation to the Public Affairs staff for making it possible. A motion was made by Council Member Mike Lester and seconded by Council Member Laura Alvarado to approve Ordinance No. 16,061, as submitted. TO ENACT THE CITY OF BAYTOWN'S COMMUNITY ACTION PLAN AS PART OF THE BAYTOWN FATHERHOOD INITIATIVE IN CONNECTION WITH THE STATE OF TEXAS' OPIOID LITIGATION; AUTHORIZING PAYMENT SOLELY FROM DISBURSEMENTS, IF ANY, THE CITY RECEIVES IN CONNECTION WITH THE STATE OF TEXAS' OPIOID LITIGATION, IN AN AMOUNT NOT TO EXCEED SEVENTY THOUSAND AND NO..' 100 DOLLARS ($70,000.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. b. Consider an ordinance amending the Code of Ordinances to adopt new fees for the City of Baytown's Development Fee Schedule, which fees include, but are not limited to subdivisions, zoning actions, and variances. This fee amendment does not affect any fees for building permits or inspections. PIanning and Development Services Director Martin Scribner provided a presentation regarding Item 3.b., amending the Code of Ordinances to adopt new fees for the City of Baytown's Development Fee Schedule. Mike Emaunel, 13 Hafer Street, stated "Distinguished Mayor, Council Members, fellow citizens and residence good evening. I want to be clear that I support this amendment this evening. The reason is because it aligns with the strategic fiscal objective of the City, so I support that. However, there is some concerns that I want the legislature to hear tonight. Being the comparative study that was performed has some flaws. This is an area that I'm very proficient in. When you do a study like this there are three key metrics that you have to look at. One of those metrics is the population of the subject: City of Baytown. Then you look at the economic base of the City. Finally, you look at the service requirements of the City. I have only three minutes to speak, so let me go ahead and address the population. Once again, I'm not against this because it fits and aligns with our goal as a City and as a whole. I do think we need to approach it with a measured gradual implementation because this comparative analysis led to fee increments as you can see on the fee schedule before you. A 100% increase and some with much more in other categories. Let me explain how problematic the competitive analysis is. For the population of the City of Sugarland it is 120 plus residents. City of Pearland is 130 plus residents. Everybody knows how many residents are in Baytown, 85. That's about 40% to 45° u population disparity, because of that they have a more financial base and they have more demands of services. What I just want to do is encourage the legislature to pass this amendment as we need it, but use your discretion to implement it gradually so that a stakeholder, a resident or a business who's used to paying $500 for a service, then this passes and they now pay $1,000. My time is up. Thank you for listening." Council Members request clarification on the specific fees associated with these development permits and discuss the implementation of recouping fees. Mr. Scribner request an extension to April 1, 2025 to allow the proper time of implementing fees into the purchasing system. DISCUSSIONS a. Discuss and take possible action regarding the City of Baytown Mayor Pro Tern. City Attorney Scott Lemond informed the Council Members of rules and procedures voted on at a prior meeting and it is recommended to suspend those guidelines prior to any actions taken on behalf of Mayor Pro Tem tonight. With the anticipation of the City Council re -implementing those procedures at a later meeting. This will help ensure clarity and avoids potential legal or procedural issues while the City Council addresses immediate matters concerning the Mayor Pro Tem. Council Members requested clarification of rules and procedures prior to taking action on the motion to suspend Resolution No. 2145 as a whole. Mr. Lemond, provided a response pertaining to the City Council request referencing suspending specific rules paragraphs l - 4 and 6 of Resolution No. 2145 for taking action on Mayor Pro Tem. A motion was made by Council Member Mike Lester and seconded by Council Member Jacob Powell to suspend Resolution No. 2145, paragraphs I - - 4 and 6. MANAGER'S REPORT City Manager Jason Reynolds presented the Manager's Report: • Parks and Recreation Department o Big shout out to the Parks & Recreation team and all the work that went into the Daddy and Me dance. I was told over 1,000 tickets were sold, and I've heard great things from everyone who has attended. Awesome job like always! • Public Works and Engineering o We got a public works call in — a resident called in to let management know that the crew did a great job and he is very pleased with the work completed near his house. Thank you to our Public Works team for everything you do for our community. We would like to give a shout out to Southside Field Supervisor, Leonard Graham, for going above and beyond. When the de- partment noticed vandalism at League of Women Voters Park on social me- dia, Leonard immediately dropped what he was doing, even after hours on the weekend, to address the issue. It could have waited, but Leonard didn't want the park to look out of sorts over the weekend when it's used the most. Big thank you to Leonard! o Part-time Recreation Tech, Dominique Gutierrez, took on the initiative of creating an in-house one -page activity guide. Her effort saves the City $30,000 in annual outsourcing costs. Great job, Dominique! • Public Affairs Department o Ryan Rawlings has obtained his drone license, which is a modified pilots license (Part 107 FAA drone license). It is not easy! So he's got two Emmy's and a Drone Pilots License. • Police Department o Assistant Chief Dana Dalbey is retiring at the end of this month after dedi- cating over 30 years of service to the City of Baytown. Throughout his ten- ure, he has been a committed and outstanding leader, playing an integral role in the safety and well-being of our community. His legacy of dedication and leadership will undoubtedly leave a lasting impact. • I want to inform citizens there is a TIRZ presentation in the coming months and how it impacts the development of the City. • An expense pertaining to the City of Baytown is available to the public and request can be made to the City Clerks office for those reports. • Regarding the Boil Water Notice; I want to thank City of Baytown Residents for their patience and grace. Due to the brittle system there was a routine water break and addressing concerns for notification to the citizen regarding the water damage. After repairs and return of water, the lines continued to break in different locations. City Council Regular Meeting Minutes February 13, 2025 Page 15 of 16 After reaching a low pressure notification we are required by law to issue a boil water notice informing TCEQ of all protocols necessary. 9. COUNCIL MEMBER DISTRICT REPORT a. Receive a report from Council Member Jacob Powell regarding projects, programs and events in District No. 5. Council Member Jacob Powell reported the current projects, programs and events of District 5: • Public Works & Engineering a East District Waste Water Treatment Phase 1 is going vertical, with the pier system being poured. o District 5's New Castle Park now has a new entrance and walking trail! Staff successfully secured an agreement with CenterPoint to add a section of con- crete sidewalk connecting the nearby neighborhood. The park will now fea- ture the new concrete trail, along with a statue purchased by the neighborhood from the ACE Districts sculpture trail. o Chambers Common life station is in its final stages, awaiting the backup generator and the electrical duct bank complete, for all the new development that is coming to 146 & I-10 area o In the last month volunteers have gathered 13 bags of litter in parks in Dis- trict 5 as part of the Adopt -a -Spot program. This includes Blue Heron Park, Barkaloo Park, and Eddie Huron Park. o Bay Oaks Harbor Street and Drainage Improvement Project is approxi- mately 80% complete and ahead of schedule. Paving work continues along Flamingo Bright and Egret Canal. The project should be substantially com- plete in October. • Planning & Development a 2610 N Alexander GCCISD new conference center- Under inspections approximately 60% complete. 0 2400 Massey Tompkins - New Convenience store and gas station - Under inspections approximately 30% complete. 0 4008 N SH 146 - Cemex Office and maintenance building Under inspec- tions approximately 25% complete. 0 3030 Ferry - COB East District Wastewater Treatment Plant New Admin Building - Under inspections approximately 30% complete. • Parks & Recreation o Newcastle Park now has a new entrance and walking trail!
