AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS,REPEALING ALL ORDINANCES AND RESOLUTIONS THAT VIOLATE
TEXAS PREEMPTION LAWS; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
WHEREAS, in June 2023, Governor Abbott signed House Bill 2127, the "Texas Regulatory
Consistency Act," into law.
WHEREAS, with various exceptions, the Bill (initially set to be effective September 1, 2023)
preempts local government ordinances, resolutions, rules,and regulations in 9 areas of state law under the
Agriculture, Business and Commerce, Finance, Insurance, Labor, Local Government, Natural
Resource, Occupation, and Property, Codes; and
WHEREAS, the Cities of Houston, San Antonio, and El Paso challenged the constitutionality of
the law and obtained a favorable ruling; and
WHEREAS, the State of Texas appealed; and
WHEREAS,the Third Court of Appeals recently overturned the trial court's decision,again making
the Texas Regulatory Consistency Act the law in the State of Texas; NOW,THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1: That it is the policy of the City to comply with State law.
Section 2: That the City shall not enforce any provisions of any policies, procedures,
ordinances, resolutions, or any other rules that violate the Texas Regulatory Consistency Act or any other
laws preempting local government authority.
Section 3: Any provisions of the City of Baytown ordinances and resolutions that violate the
Texas Regulatory Consistency Act or other laws preempting local government authority are, hereby,
repealed,the aforementioned shall not affect the validity of the remaining provisions of the City of Baytown
ordinances and resolutions that are not in violation of the Texas Regulatory Consistency Act.
Section 4: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
