Ordinance No. 16,231 ORDINANCE NO. 16,231 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, RATIFYING EMERGENCY AND UNFORESEEN REPAIR SERVICES TO THE CITY HALL HVAC CHILLER; AUTHORIZING PAYMENT TO AMERICAN MECHANICAL SERVICES OF TEXAS IN AN AMOUNT OF ONE HUNDRED EIGHTY-TWO THOUSAND FIVE HUNDRED NINE DOLLARS AND 681100 DOLLARS ($182,509.68); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Section 252.022(a)(3) of the Texas Local Government Code exempts from state law competitive bidding requirements an expenditure for a procurement necessary because of unforeseen damage to public machinery, equipment, or other property; and WHEREAS, American Mechanical Services of Houston, LLC was initially engaged by the City, pursuant to the As-Needed Repair Services Contract, to complete a small repair to the underground lines connecting the HVAC chillers behind City Hall; and WHEREAS, during the course of the repair, additional and unforeseen major damage was discovered, requiring all lines to be replaced, thereby expanding the scope and cost of the repair; and WHEREAS, if the lines were not immediately repaired, City Hall would have been without heat or air conditioning for an extended period, approximately two to three months, thereby potentially impacting services provided to residents; and WHEREAS, the City Council of the City of Baytown, Texas now desires to ratify the expenditure made pursuant to Texas Local Government Code Section 252.022(a)(3) for the emergency repair of unforeseen damage to the City Hall HVAC chiller; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That all matters and facts set forth in the recitals hereinabove are found to be true and are approved by the City Council of the City of Baytown, Texas. Section 2: That the City Council of the City of Baytown hereby ratifies the expenditure for emergency and unforeseen repair services to the City Hall HVAC chiller, and authorizes payment in an amount of ONE HUNDRED EIGHTY-TWO THOUSAND FIVE HUNDRED NINE DOLLARS AND 68.100 DOLLARS ($182,509.68) to American Mechanical Services of Houston, LLC. Section 3: That pursuant to the provisions of Texas Local Government Code Annotated § 252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND N01 100 DOLLARS ($50,000.00) or less, subject to the provision that the original contract price may not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
