Ordinance No. 16,216 ORDINANCE NO. 16,216 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PAYMENT OF SIXTY-EIGHT THOUSAND FIVE HUNDRED FORTY-FOUR AND 78 100 DOLLARS ($68,544.78) TO DELL MARKETING L.P., FOR THE DELL ME5084 STORAGE ARRAY AND RELATED PARTS THROUGH THE TEXAS DEPARTMENT OF INFORMATION RESOURCES COOPERATIVE PURCHASING CONTRACT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City of Baytown has entered into an interlocal cooperative contract with the Texas Department of Information Resources("DIR") for the purchase of licenses necessary for the use and maintenance of all City servers; and WHEREAS, the DIR's purchasing process includes posting the request on the Electronic State Business Daily (ESBD), gathering and reviewing the vendors' responses to the posting, negotiating with selected vendors, and managing vendor contracts; and WHEREAS, such process, in combination with the interlocal cooperative contract, allows the City to purchase automated information systems products and;or services in an efficient, cost- effective, and competitive procurement method; and WHEREAS, the City of Baytown, in making a purchase under a DIR contract through its interlocal cooperation contract,satisfies state law requiring municipalities to seek competitive bids for the purchase of the item; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes the payment of SIXTY-EIGHT THOUSAND FIVE HUNDRED FORTY-FOUR AND 78:100 DOLLARS ($68,544.78) to Dell Marketing, L.P., for the purchase of a Dell Me 5084 Storage array and related parts necessary to support the license plate reader(LPR) data retention for the next five years. Section 2: That the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO-'100 DOLLARS ($50,000 00) or less, provided that the original contract pace may not be increased by more than twenty-five percent(25°-0)or decreased by more than twenty-five percent(251.o)without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
