CC Resolution No. 3019RESOLUTION NO. 3019 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ADOPTING THE 2025-2029 CITIZEN PARTICIPATION PLAN FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the Community Development Block Grant ("CDBG") Program has operated since 1974 to provide local governments with the resources necessary to meet the needs of low and moderate -income residents; and WHEREAS, annually, the Department of Housing and Urban Development ("HUD") issues entitlements to local governments, including the City of Baytown, and allows those units of government flexibility to develop programs that meet the unique needs of their community; and WHEREAS, HUD requires entitlement jurisdictions to adopt a Citizen Participation Plan; and WHEREAS, the City of Baytown likewise desires citizen participation in the CDBG Program and believes that citizen participation is necessary in order for (1) the needs of the citizens of Baytown to be determined, (11) the priorities that address those needs be set, and (111) input of the citizens to be incorporated in the development of each yearly application to HUD; and WHEREAS, on June 17, 2025, the Community Development Advisory Committee ("CDAC") affirmatively voted to recommend the 2025-2029 Citizen Participation Plan for adoption by City Council; and WHEREAS, based, in part, upon the recommendation of the CDAC, the City Council desires to adopt the Plan; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section l: That the City Council of the City of Baytown, Texas, has reviewed the 2025-2029 Citizen Participation Plan (the "Plan") and hereby adopts the Plan, which is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes. Section 2: That the City Council of the City of Baytown, Texas, hereby authorizes the submission of the Plan to the United States Department of Housing and Urban Development. Section 3: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown, Texas. Administered by the U.S. Department of Housing and Urban Development (HUD), the program allocates annual entitlement funds to eligible states, counties, and cities. These funds provide local jurisdictions with the flexibility to design and implement programs that address the unique needs and priorities of their communities. Each year, HUD distributes entitlement funds to eligible states, counties, and cities across the country. These funds are intended to empower local jurisdictions to design and implement programs that are responsive to the specific needs of their communities, including affordable housing development, neighborhood revitalization, infrastructure improvements, and social services. The City of Baytown is a recipient of annual CDBG entitlement funding. In alignment with HUD requirements and the City's commitment to transparency, accountability, and inclusion, Baytown has developed a comprehensive Citizen Participation Plan (CPP). This Plan ensures that residents, community organizations, businesses, and other stakeholders are actively engaged in the decision - making process surrounding the use of CDBG funds. Although federal regulations use the term "Citizen Participation Plan," it is important to note that neither HUD nor the City of Baytown limits participation to U.S. citizens. In Baytown, participation is open to all residents and stakeholders regardless of citizenship status, including individuals, advocacy groups, nonprofit organizations, business owners, and any party with a vested interest in the equitable and effective use of federal funds. The Plan is intended to serve as a framework for inclusive engagement, ensuring that marginalized and underserved populations —including low- to moderate -income residents, racial and ethnic minorities, persons with disabilities, and those living in blighted or under-resourced neighborhoods —have meaningful opportunities to shape CDBG priorities and outcomes. HUD requires that all grantees develop and maintain a Citizen Participation Plan as a condition of receiving CDBG funds, per 24 CFR §91.100 and §91.105. These federal regulations specify that participation must be: Encouraged throughout all stages of program planning and implementation; • Accessible to those who are most affected by community development decisions; • Documented and transparent, with feedback loops demonstrating how input has been considered. The Plan also identifies the specific CDBG-related reports and documents that require public input and review, including: • The 5-Year Consolidated Plan, which sets long-term goals and funding priorities; • The Annual Action Plan, which details yearly activities and budget allocations; • The Assessment of Fair Housing (AFH) or 5-Year Fair Housing Plan; • The Environmental Review Record (ERR), which assesses environmental impacts of funded activities; • The Consolidated Annual Performance and Evaluation Report (CAPER), which reports on the outcomes of funded projects. Community development needs and priorities may evolve over time, requiring adjustments to the City's originally approved plans. The CPP outlines the criteria for determining when a "substantial amendment" is needed —such as a significant reallocation of funds, cancellation of a previously approved activity, or the introduction of a new activity not previously identified. When such changes occur, the City must follow federal public notification and comment procedures, including informing the public, allowing sufficient time for feedback, and incorporating community responses into the decision -making process. The City of Baytown updates its Citizen Participation Plan every five years in conjunction with the development of the 5-Year Consolidated Plan. This update process ensures that the CPP remains relevant, effective, and responsive to changing community dynamics and emerging needs. The City recognizes that building an equitable and vibrant community depends on strong partnerships and consistent communication between residents and local government. Baytown is committed to facilitating robust participation throughout the CDBG program cycle. Special efforts are made to reach historically underrepresented communities, such as: • Low- to moderate -income individuals and families; • Minority populations; • Persons with disabilities; • Residents of neighborhoods with substandard infrastructure or lacking basic amenities. Participation is also strongly encouraged from: • Local nonprofit organizations and service providers; • Faith -based institutions; • Business owners; • Advocacy coalitions; • The Baytown Housing Authority and other public agencies. The Community Development Division provides staff support year-round to answer questions, receive input, and promote public awareness of CDBG programs. Outlines how the public can obtain CDBG-related documents and data. Ensures materials are available in accessible formats and languages as needed.
