ORDINANCE NO. 16,201 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING DEDUCTIVE CHANGE ORDER NO. 1 FOR THE BAYTOWN SIDEWALK PHASE II PROJECT WITH MBN ENTERPRISES, LLC; APPROVING A DECREASE IN THE CONTRACT AMOUNT BY FOUR HUNDRED SIXTY-SEVEN THOUSAND, TWO HUNDRED SEVENTY- SEVEN DOLLARS AND 09/100. ($467,277.09); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section l: That the City Council does hereby authorize Change Order No. 1 for the Sidewalk Phase II Project with MBN Enterprises, LLC, decreasing the contract amount by FOUR HUNDRED SIXTY-SEVEN THOUSAND, TWO HUNDRED SEVENTY-SEVEN DOLLARS AND NINE CENTS. ($467,277.09). A copy of said change order is attached hereto, marked Exhibit "A" and made a part hereof for all intents and purposes. Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. Quantities were adjusted due to changes that were made within the Right -of -Way (ROW) by adjacent property owners, utility/telecom providers, and based on field condtions discovered as construction was in progress. The largest change is a reduction in the scope of work. MBN Enterprises, LLC, and the City of Baytown mutally agreed that it was in the best interest of both parties to rebid the Decker Drive segment of the sidewalk due to delays in obtaining the permit process with TxDOT and ExxonMobil's pipeline easement.
