FOR THE EAST DISTRICT WASTEWATER TREATMENT PLANT PHASE 1 PROJECT; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN AN AMOUNT OF THIRTY-TWO THOUSAND SEVEN HUNDRED ELEVEN AND NO/100 DOLLARS ($32,711.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes and directs the City Manager to execute and the City Clerk to attest to the First Amendment to the Professional Services Agreement with Raba Kristner, Inc. for the East District Wastewater Treatment Plant Phase 1 Project. A copy of said amendment is attached hereto as Exhibit "A" and incorporated herein for all intents and purposes. Section 2: That the City Council of the City of Baytown authorizes payment to Raba Kristner, Inc. in an amount of THIRTY-TWO THOUSAND SEVEN HUNDRED ELEVEN AND NO/100 DOLLARS ($32,711.00) for consulting services in accordance with the amendment authorized in Section 1 hereinabove. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. BIT TER BONN Amendment No: 01 Project No: WWTP2002 PO/Contract#: 2414619/4250166 Explanation: The purpose for this amendment is the modification in scope of work for the East District Wastewater Treatment Plant Phase 1 Project. Raba Kistner, Inc., is asking for an additional $32,711.00 for the materials testing for the project. The consultant's original estimation of the materials testing for the project has been exhausted in the early stages of the project. The number of soil compaction and concrete cylinder's requested has exceeded the original amount that Raba Kistner indicated on the original proposal. Raba Kistner indicates they were not provided a copy of the constriction schedule therefore that explains the shortage. LEM Construction Company, Inc., has reviewed the remaining construction schedule and has estimated a quantity of 15 events that materials testing will be required for the remaining constriction. The additional funds requested by Raba Kistner should carry the project until completion. Description of Work Cost Time 1. Nothing contained in this Amendment or in the Agreement shall be construed in any way to limit or to waive the City's sovereign immunity. The persons executing this Agreement hereby represent that each party has the full power and authority to enter into and perform pursuant to the Amendment, and that each has been properly authorized and empowered to enter into the Amendment.
