AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
APPROVING THE CONTRACT WITH KFT FIRE TRAINING,LLC,FOR PREVENTATIVE
MAINTENANCE ON CERTAIN FIRE TRAINING PROPS AT THE BAYTOWN FIRE
TRAINING FIELD, AUTHORIZING PAYMENT THEREFOR IN AN AMOUNT NOT TO
EXCEED THIRTEEN THOUSAND FIVE HUNDRED SIXTY-TWO AND NO'100
($13,562.00); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1: That the City Council of the City of Baytown, Texas,hereby approves the contract with
KFT Fire Training, LLC, for preventative maintenance on certain fire training props at the Baytown Fire Training
Field, under terms and conditions in the attached contract in Exhibit"A"which is incorporated by reference as if
fully set forth herein.
Section 2: That the City Council of the City of Baytown, Texas, authorizes payment to KFT Fire
Training, LLC in an amount not to exceed THIRTEEN THOUSAND FIVE HUNDRED SIXTY-TWO AND
NO:100 ($13,562.00),pursuant to the agreement identified in Section 1 hereof.
Section 3: That pursuant to the provisions of Texas Local Government Code Annotated §252.048,
the City Manager is hereby granted general authority to approve any change order involving a decrease or an
increase in costs of FIFTY THOUSAND AND NO: 100 DOLLARS ($50,000.00)or less, subject to the provision
that the original contract price may not be increased by more than twenty five percent(250 u)or decreased by more
than twenty five percent(251 o)without the consent of the contractor to such decrease.
Section 4: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.

b. System hardware that has been abused or damaged.
c. System hardware that has been repaired, modified, or replaced by third parties.
d. Loss of owner's ability to train because of conditions beyond KFT's control.
8. Time and Material pricing structure. Unplanned (Corrective) Support (without coverage) Cost are billed
at the following rates:

Travel time $140.00 per hour
